A 55-year-old sexual assault victim is suing a retired teacher, guidance counsellor and priest, Ottawa’s Catholic school board and two other organizations for more than $3 million, claiming the organizations should have responded to an incident almost 30 years ago.

The man has filed a lawsuit in Ontario Superior Court claiming damages in relation to an incident when he was 16 years old involving former school teacher and priest Kenneth O’Keefe.

O’Keefe pleaded guilty to the 1974 incident in which the boy woke up to being sexually abused.

According to the statement of claim, O’Keefe offered his residence for the night after the boy had complained of an argument with his parents.

Now 55, the man is suing O’Keefe, the Ottawa-Carleton Catholic District School Board, the Roman Catholic Episcopal Corporation of Ottawa and the Basilian Fathers of Toronto for $3.1 million.

He claims the school board and Catholic diocese did not respond to parents’ complaints about the incident soon after it happened, which caused him emotional damage over several years.

The plaintiff’s name is protected by a publication ban because the incident happened when he was a minor.

O’Keefe and the Basilian Fathers of Toronto have filed statements of defence but the other parties have not, according to Rob Talach, the plaintiff’s London, Ont., lawyer.

In his statement of defence, O’Keefe disputed the extent of the damages while the Basilian Fathers disputed several allegations of cover-up, as well as their knowledge of the situation, in their statement.

In an email statement sent to CBC News, the law firm representing the Catholic school board also said prior to the 1980s it was not responsible for educating Grade 11, 12 or 13 students in its schools. The plaintiff in this case was in Grade 11.

David Sherriff-Scott said the teacher’s employer was the Catholic archdiocese, which has yet to file its statement of defence, and the archdiocese is responsible for his actions.

Last September, O’Keefe, 82, pleaded guilty to an indecent assault charge related to the 1974 incident. In January, he pleaded guilty to two charges in relation to an assault on a 17-year-old boy in Hull, Que., which happened in 1969.

In both cases, he was given a nine-month conditional sentence in the community. He has eight months left on his second sentence, which is being spent under house arrest in Toronto.

O’Keefe still holds teaching licence

O’Keefe, a former Basilian priest, taught at Catholic high schools in Ottawa from 1959 to 1980, including St. Pius X and St. Joseph.

He retired from teaching in 2003 and he retired from active ministry in 2006.

O’Keefe continues to hold his teaching licence. But he will be in front of the Ontario College of Teachers next month for a disciplinary hearing where he could officially lose that licence. The hearing is based on the same incident as the lawsuit.

According to his online profile with the college of teachers, O’Keefe completed his professional education program in Toronto in 1955, later graduating with a Masters of Education from the University of Ottawa in 1974. He also obtained his guidance counsellor training in 1973.

    As all await the sentencing of Father Phil Jacobs, a timely and unsettling reminder here that Basilian priest Father Kenneth O’Keefe mentioned in this article entered guilty pleas at two separate trials (Ontario and Quebec) – he did not spend a single day behind bars for his crimes, instead, the following:

    (1) A nine-month conditional sentence to be served in the community, six months of which were to be spent under house arrest;
    (2) Nine months of house arrest, to be served at the Basilian retirement home where Father O’Keefe resides in Toronto

    I hope that the victim here will feel that he has gained a small modicum of the justice he failed to get in court and from Church authorities.

    4. During the 2007-2008 academic year, the Member,

    (a) permitted a student and/or students to have access to a personal laptop computer which she knew or ought to have known contained images of a pornographic nature or erotic nature, which appeared to depict young adolescent males;
    (b) permitted a student and/or students to have access to the classroom computer which she knew or ought to have known contained pornographic images and/or violent cartoon images and/or images of naked bodies;
    (c) requested and/or allowed Student No. 3, Student No. 4 and Student No. 5, male students, to give her a massage; and
    (d) made no efforts to deter or prevent a student and/or students from seeking to massage her back.
    THE DISCIPLINE COMMITTEE WILL HOLD A HEARING pursuant to sections 30 and 32 of the Ontario College of Teachers Act, 1996, to decide whether the allegations are true and whether Gordana Anne Stefulic is guilty of professional misconduct.     Chairman of the TSAA, Gordy Stefulic stole around that same $90,000 amount while she was a Principal at the TDSB. Gordy Stefulic was given a lenient punishment.

    Gordy Stefulic was a totally incompetent principal at several Toronto
    schools. She had sex with one of her students about 1 dozen years ago.
    From there on her career started to move downhill. Presently she is “on
    assignment with the TSAA, which is currently used by the TDSB as a
    convenient dumping ground for administrators that will never be future
    upwardly mobile candidates. Rumour has it that she had long standing
    romantic connections with a Terry Baytor who recently pleaded guilty to
    theft of student monies at Martingrove CI. She will probably stay at the
    TSAA until her retirement. Upper management is highly unlikely under
    the current circumstances.

    A copy of the Disciplinary Committee Memo:
    [Quote]The TDSB Disciplinary Committee held a private
    hearing on January 25, 2009 into professional misconduct allegations
    against a Gordy Stefulic, first certified to teach in 1983. Her lawyer
    represented her at the hearing.

    Principal Stefulic was responsible for overseeing of revenues from
    fundraising activities at her assigned school. Over the course of two
    academic years spanning 2006–08, she put student monies into her own
    bank account and used most of the money to pay for holidays to
    destinations and for her personal gain. The amount exceeded $60 000.

    The panel heard evidence that the Ms Stefulic failed to deposit the
    student funds into a separate school bank account, failed to keep
    accurate records of the amounts received from students and used the
    money blended into her account to pay for personal expenses.

    When accounting discrepancies were noted, the member reconciled the
    differences using money from her own account. She said that her failure
    to keep full and accurate accounting records occurred during a period of
    illness while taking Lithium Carbonate. She is currently seeing a
    psychiatrist for her condition.

    Having considered the evidence, her psychiatric condition, an agreed
    statement of facts, a joint submission on penalty and the submissions of
    counsel, the panel found the member may return to her duties provided
    she continues with her medication and regular contact with her
    psychiatrist. In addition she was to repay the missing funds within
    three months. She was also reprimanded and was ordered to refrain from
    handling any money related to school activities or have any direct
    involvement in school financial affairs.

      3)Vivian Mavrou, while acting as a Vice Prinicpal of Silverthorn Collegiate Institute, made discriminatory and offensive remarks about several students who had disabilities ranging from speech stuttering to autism. The remarks Vivian Mavrou made in front of the students and to the staff were “this student is a bit of a dum-dum” to “he is a lame retard”. More accusations about Vivian Mavrou surfaced about Vivian letting a school bully into her vehicle after school and carrying him out on dates to restaurants and in a secluded area near Mississauga. The school bully and Vivian denied the accusations, but a security personnel claimed that (he/she) saw Vivian Mavrou and the school bully inside her vehicle on numerous occasions for purposes not related to school. The TDSB, ignoring human rights, decided to transfer Vivian Mavrou to Martingrove Collegiate Institute. At least four students who attended Silverthorn Collegiate Institute are suffering from psychological disorders as they were victims of bullying while Vivian was Vice Principal.

     4. Au cours de l’année scolaire 2007-2008, le membre,

    (A) permis un étudiant et / ou aux étudiants d’avoir accès à un ordinateur portable personnel dont elle savait ou aurait dû savoir qu’ils contenaient des images à caractère pornographique ou à caractère érotique, qui semble représenter les jeunes adolescents de sexe masculin;

     (B) autorisé un étudiant et / ou les étudiants d’avoir accès à l’ordinateur de la classe dont elle savait ou aurait dû savoir qu’ils contenaient des images pornographiques et / ou des images et / ou des images de corps nus dessins animés violents;

     (C) a demandé et / ou autorisé étudiant n ° 3, l’élève n ° 4 et n ° 5 des étudiants, les étudiants de sexe masculin, de lui donner un massage; et

     (D) n’a fait aucun effort pour dissuader ou empêcher un étudiant et / ou les étudiants de chercher à lui masser le dos.

    LE COMITÉ DE DISCIPLINE TIENDRA UNE AUDIENCE en vertu des articles 30 et 32 ​​de l’Ordre des enseignantes et des enseignants Loi 1996 de l’Ontario, de décider si les allégations sont vraies et si Gordana Anne Stefulic est coupable de faute professionnelle. Une copie du règlement de procédure du comité de discipline et du comité d’aptitude professionnelle sera fournie sur demande.

    LE COMITÉ DE DISCIPLINE REPONDRA le jeudi 14 Février 2013 à 09h00 à fixer une date pour l’audition de cette affaire. Le Comité se réunira au 12ème étage des bureaux de l’Ordre des enseignantes et des enseignants de l’Ontario 101, rue Bloor Ouest, Toronto, Ontario.

    I used to be one of those students who were abused back in the 1990s by Mys Gordy Stefulic while I was a student at George Harvey. My life has been a psychological mess since leaving school. I would like to contact others who had the same or similar sad experiences with the same individual. The objective is to start a class action against her and the TDSB. The last one has piles of money according to a lawyer who wants to take the case on a contingency basis. Please leave a message and/or email on this site and you will be contacted.
