Basilian priest.  Ordained 1951.  Laicized/defrocked sometime after his June 2011 guilty pleas.  Died 28 July 2014

Charged:  May 2010 in Windsor, Ontario;   September 2010 in Toronto, Ontario;  October 2010 in Sudbury, Ontario and February 2012 in Saskatoon, Saskatchewan.

GUILTY 08 June 2011  in Windsor, Ontario on charges from Ontario :  17 charges related to sex abuse of 17 victims (16 male: 1 female)  (there are conflicting accounts of the numbers, some have 16, others 17) Sentenced to two years in jail.

In July 2011 several men in Saskatoon came forward alleging sex abuse by Marshall as teens.   10 November 2011:  Saskatoon police conducted an investigation and turned the file over to the Crown attorney in Regina Saskatchewan.  07 February 2012: charges were laid relating to indecent assault of two Saskatoon boys in 1959 and 1960

April 2018:  $2.5M settlement awarded victim in civil jury trial.  According to information attained through evidence and testimony  Hod Marshall was reported to his Basilian superiors six times, the earliest of those being in 1947- four years BEFORE his ordination to the priesthood.  He was also sent off for “treatment” three times, ie  1978:  Washington DC ( this may have been at St. Lukes’s Institute which is just outside Washington); June 1979:   Southdown (Aurora Ontario), and; sometime 1996-sometime1997:  St. Luke’s Institute , Maryland

(Cardinal George Flahiff was elected Superior of the Canadian Basilians in 1951.  From 1954 to 1960 Flahiff served as Superior General of the Basilian congregation worldwide.

The current Bishop of London, Ontario, Ronald Peter Fabbro csb, was Superior of the Canadian Basilians from 1997-2002)

According to Houston Chronicle Marshall moved to St. Lucia 1993 and retired in 1997, however he was in St. Lucia from ’89 until he was reported in ’96 and sent off to St. Luke’s Institute for “treatment.”   The CCCD indicates he was “out of Canada.”

(20 June 2011:  I have been informed that Hod Marshall helped to establish the Holy Family Children’s Home in Ciceron which served boys and girls from newborn to age 14.  I have also been told he served as pastor at St. Benedict’s Church in Ciceron and in that capacity would have paid regular visits to the Ciceron school.)

According to the Toronto Globe and Mail (23 Sept. ’10) a complaint was received about Marshall in 1996 and he was recalled – he was sent for ‘treatment’ to the Saint Luke Institute in Maryland (we now know that Hod was pulled from St.Lucia and sent to St. Luke’s after a victim contacted the Basilians:  when Hod Marshall was confronted he did not deny the allegations.  The victim did not want to go to police at that time. )

HOW WE BECAME KNIGHTS

Our founding principal, Fr. Hod Marshall, was a member/brother of the Knights of Columbus Holy Family Council 4386 in South Windsor. He attended monthly meetings at the K of C and constantly reminded the members of the importance of Catholic Education. Fr. Hod had a vision of establishing a Catholic High school in South Windsor. In 1985 when Holy Names High School opened at the former St. Huberts School on California Ave., the K of C presented Fr. Hod Marshall and students with a cheque for the purchase of their first set of basketball jerseys. Fr. Marshall then announced that all teams and clubs would be known as the Holy Names Knights.

(Marshall is referenced as “of Assumption College.”  A reminder here that Marshall was possibly travelling back and forth to Toronto throughout the years and, although serving elsewhere,  in this case Assumption in Windsor, was perhaps occasionally – or frequently? – involved in St. Michael’s College School special events, i.e., the dedication of the shrine)

Mid 50s:  sometime in the mid 50s spent a few months living in the rectory at St. John the Baptist Roman Catholic Church in Amherstbourg, Ontario – allegedly suffering from nervous exhaustion

1950 – 1954:  Toronto’s St. Michael’s College School yearbooks.  Teaching Math.  Coaching football and/or basketball teams.    (yearbooks & CCCDs)

raised in Westmount, Montreal, Quebec.  I have been told that he attended a Christian Brothers School believed to be called D’Arcy McGee.  There was a D’Arcy McGee high school in the heart of Montreal which was once operated by the Christian Brothers.  It was the first English Catholic high school in Montreal.  It closed in 1992

Former Ontario priest, 87, charged with sexual abuse

WINDSOR, Ont. — A Basilian priest and former Windsor, Ont., high school principal who is now in his late-80s, has been charged with sexually abusing a child in an allegation that dates back to the 1980s.

Rev. William Hodgson (Hod) Marshall, 87, appeared in court Wednesday to face a charge of sexual abuse for incidents that occurred while he was working at a Windsor school from 1981 to 1985.

It is unclear which school Marshall was serving during the years the alleged incidents took place, and it is unknown whether his alleged victim was a student.

Windsor police said the investigation started “a while back,” but police were unable to share details of the case Thursday night.

A statement from the religious order expressed sympathy for any victims of sexual abuse.

“The Basilian Fathers are deeply concerned and regretful that one of their members is alleged to have abused a minor,” reads a statement issued by the General Council of the Congregation of Priests of St. Basil. “Our hearts and minds turn immediately to the victim who has come forward.”

By 1993, he had retired from the school system and had moved to St. Lucia to carry out missionary work.

He didn’t lose his connection with Windsor after moving south, though. The priest spearheaded projects that brought students to the Caribbean island to build homes and to help with the construction of schools and daycares.

Marshall retired from the public ministry in 1997 and moved to a residence for Basilian priests in Toronto.

While working in northern Ontario, “Father Hod” became known as the “basketball priest” for his dedicated attendance at games.

“Anything I can get students interested in, I will,” he told The Windsor Star in 1985. “And I attend everything I can. I like to get in there and see the kids, see them doing something worthwhile and developing their talents.”

Neither Marshall nor representatives of the Catholic school board could be reached for comment Thursday evening.

I hope it was just the Star getting it wrong and not the police. He wasn’t even in Windsor from 1981-1985. He was busy abusing boys in Sault St. Marie. He came to Windsor for the ’85-’86 school year. That was when he started abusing in Windsor – not 1981-1985. Before the Sault he was abusing in Sudbury.

Moved to St. Lucia for missionary work did he?? That wasn’t all he was doing down there. He got kicked out of the country for a REASON and never EVER returned even once for a visit.

Just one question? Did he plead guilty.

Court dates and parole hearings

Parole hearing:  Marshall has waived his right for further parole board review.  He can refile if he chooses.  As it stands 23 April 2012, he will be released 05 October 2012;  08 October 2012; 30 May 2012; 27 March 2012 probably in Kingston, Ontario?

    My two cents, Sylvia…

    In an ideal situation everyone is heard, in a perfect “Justice” system…then the Crown will consider what is going to be achieved, how much it will “cost” and whether any more deterrence or punishment will result..how busy the Courts are…and so on . Making the victims feel better has never been a criteria in my experience… Frustrating but what more will they achieve by “beating a dead horse”…meaning the accused… and certainly not because we should feel satisfied about the “system”… Sad but not everyone gets justice.

    Any victim should lodge a complaint however and they should get/expect a written explanation from Police or Crown . That way it is more difficult to sweep under the rug and there is a record on file.

    We are all equal.. but some are more equal than others (Orwell)..This stinks of liberal politiking. Let me tell you if my kids had ever been hurt by the likes of these criminals I would raise Cain to get justice. I really would not give a fiddler’s truck if the Crown, Defense and the Bench would have struck a deal. I am guessing they learned their lessons well from the Corwall case and now have refined ho they oppress the survivors..The media and persuing private human rights legislation based on being discriminated would be one of means I would suggest. I get so enraged at this case and I know second hand how it has ruined personal lives.. and so many more… just like Dejeager way way more than seventeen people out there and they all have a right to be heard and to have closure bt way of the justice system.

    To all of you above, my respect for your bravery and being to maintain and try to get on with living with a semblance of normality while carrying such an awful burden. A burden that should be placed at the foot of the courts and our society so that it can be aknowledged and so that you can engage in your recovery by becoming survivors rather than victim. I hate to post the same quote over and over but in this instance it a propos.

    The Honourable Chris Bentley:

    I am writing regarding a sentence given to Father William Hodgson Marshall on June 8th and 9th, 2011 in Windsor Superior Court. Father Marshall recieved a two year sentence, but I heard through a few of the victims that part of the plea agreement between Crown Walter Costa and attorney Andrew Bradie, was that no further charges would be entertained against Father Marshall. The case was heard in front of Justice Lloyd Dean.

    I am asking your office to confirm if indeed part of the plea agreement was the fact that no further charges would be entertained, and how far reaching that agreement (if fact) stretches. Is it just Windsor? Is it Windsor, Toronto and Sudbury? Is it all of Ontario? Or…….Is it all of Canada?

    Tuesday July 5th…..I spoke with a person this morning who would definetely have knowledge of prosecutorial matters, as this person has prosecuted cases for many years in jurisdictions in Ontario.

    I wanted to know if the deal that “Happy Hands” was given (re: “that no further criminal charges would be entertained”);

    Was it in fact “legal”?

    How far did the deal reach jurisdictionally?

    Would the “deal” had to have been okayed by a higher authority?

    His answers were…….In the many years that he had been prosecuting, he had never brokered such a deal that allowed a perpetartor to walk away from any further charges. The only example that he could draw on was the Alfred Training School case (maybe Sylvia can expand on this).

    The “deal” MAY be far reaching; as it is a charge under the Criminal Code of Canada, although the feds have handed prosecution powers to the provinces. It may be argued by a “damn good lawyer”.

    The “deal” would have been okayed by a higher up. He said although not much makes it to the AG’s desk, it would had to have been passed by the Deputy Attorney General (Murray Segal).

    One suggestion he made was to call Crown Attorney Walter Costa. I did that this afternoon, Mr. Costa is out of the office the remainder of this week, and will return on Monday July, 11th. I will be calling him back then, as his secretary was unable to confirm any of the details. I will post then.

    Good work John. Keep at it. It makes all the sense in the world that, if such an agreement exists, it could not have been struck without a nod from the Ontario AG, or someone giving the nod on the AG’s behalf. Thayt would be for Ontario.

    I don’t see how it could extend beyond Ontario? I await with keen interst to see what you leanr from Mr. Costan.

    As for Alfred…

    I do recall that the deal negotiated there negated other victims coming forward to sue after the whole conflict resolution process was wrapped up. I have a vague rcollection that it also negated further charges being laid, but I’m a little fuzzy on that.
    I remember being annoyed and wondering how ‘they’ could do that when it was highly possible there were victims who knew nothing of the deal who would effectivley be ostracized. What I don’t recall is: was my upset over the fact victims could not sue, or that they could not proceed with criminal charges, or both? I think it was both, but will have to find time to check my files.

    Is there anyone out there who knows with certainty?

    Jason Warick of the Saskatoon Star Phoenix did an excellent follow up article about yet another man, Bob Kloshinsky who came forward after reading about Gary Mulligan, the second friend and me. Jason tells me it’s the biggest story in a year for his paper (from the feedback volume). The church is still doing a dance around Jason’s questioning…. same old same old. Jason tells me there is yet a third article coming. Lots of people congratulate me and strangers walk up to shake hands, one negative comment.

    hod is in jail.Patrick,who lifted he heavy weight,has been vindicated and his complaint has beenverified by 16 other victims.This would not have happened without Walter Costa,who decided that Patrick’s complaint had legitimacy and steered it forward to its conclusion.Other victims had a year following Patrick’s trailblazing effort to get on board.That they didn’t was an indication that they weredead or that they could not come forward.Therefor , thedeal.It was open and if you check back you will see that it was pointed out from numerous sources.In addition,Essex county has the precedent of Sylvestre,who died in jail.His sentence you may recall was 3years.Thank you patrick for leading the charge,thank you walter for saying this complaint is going forward and thank you for those who could join in to show the nature of the beast.It may be that other victims in ontario may be excluded,but not those from st.pauls,nor texas,nor st.lucia.Additionally,there is evidence yet to surface that the basilian heirarchy knew and hid hod for a short period of time which enabled hod to offend many more inocent boys.Move on to press to have the enablers face the judge.

    I don’t understand former student how a deal can be cut which denies “alleged” victims the opportunity to legally say they are victims. I don’t for a moment question Patrick, or the good work which Walter Costa did to, as you say “show the nature of the beast.”

    I know how important it is to many victims to have their day in court. How can that be denied them? I am trying to wrap my head around what happens if, for example, someone in, say, the Soo, finally gets the courage to walk into a police station and tell a police officer that Hod Marshall did whatever to hm or her and they want charges laid? What next?

    Do all the police in Ontario know that there are to be no more charges laid against Hod Marshall? Perhaps they do, but I can’t imagine how that can be accomplished. Is an alert sent around to every police serivce, and every OPP and RCMP detachment advising that no further charges are to be laid against Hod Marshall in Ontario?

    How does it work?

    So, if police officers don’t know, then what? They investigate, and decide there is sufficient evidence to lay charges. And, then what? At what point does the complainant find out that charges can not be laid because there was a deal? Who breaks that bizarre bit of news? And, how?

    And if police officers do know, how do they handle that poor soul who finally got him or herself down to the police station? “Sorry, too late.”?

    How are those people handled? What explantion is offered?

    Yet again I am trying to understand. Make sense of this for me someone. Please, make sense of it in such a way that I know that no one will be hurt if and when they finally take that step which they have fought against and/or wrestled with 20, 30 or 40 years. That’s my one and only concern.

    The picture of ‘Happy Hands’ from the St. Michael’s College School yearbook is downright scary. The young fella pictured on the left seems to be shielding his genitals, and very obviously, rightly so. And Hod looks like he is giving the guy on the extreme right “the eye”. The other guy just looks scared. After reading all the stories on this demented “priest”, this picture really makes you wonder what was going on there, and it begs for questions. Who are these young teens? Where are they now? Has anyone spoken with them? Good to see that this pedophile is locked up. That is too good for him. Everybody knows what should really happen to this guy ……. 10 minutes in a locked room with the victim’s father. That should be the only type of justice for freaks like this. If this was indeed the penalty doled out to these pedophiles, I can’t help but think that incidents such as these would stop dead in their tracks.

    One of the methods I use to cope with having been abused is to write about it. I find this therapeutic. When I began to deal with my past, I vowed that I would do what I could to convert this negative childhood experience into something positive.

    Currently, I am writing a blog in which I express my feelings and opinions on many aspects of the abuse. Up until last summer, I thought I was the only one who had been abused by my pepetrator. Then I attended a SNAP conference in Chicago. SNAP is an acronym for survivors’ network for those abused by priests. They have a worldwide membership of over 10,000 victims! For the first time in my life, I felt connected to other victims. They understood me and I understood them for my story was theirs and theirs was mine. I had the same feeling in June of this year when I attended the sentencing in Windsor. I met many fine people who had experienced abuse as had I. Please feel free to participate in my blog by leaving a comment or just reading it if it will make you feel better. Check it out at kenhills.blogspot.com. I think there is a link from Sylvia’s site but I am not sure where it is. I will shortly publish a letter to the Pope (anyone know his address) calling for the laicization of pedophile priests.     I commend you for your intent to write to the Pope asking for the laicization of clerical molesters.     I have been told that, in the mid 50s, Hod Marshall spent a few months living in the rectory at St. John the Baptist Church in Amherstbourg, Ontario. He was allegedly suffering from nervous exhaustion.

    Is there anyone out there from Amherstbourg who knows more about this?

    The Saskatoon Police has turned over its file on Marshall to the Crown attorney in Regina Sask. and is awaiting further instruction.

    Yesterday I placed a call to the Saskatoon police sexual assault division to find out the status of the investigation because, as you know, we haven’t heard a word. This morning I received a return call, very bright and early. The case is still very much alive.

    This goes out to the other 16 amazing friends who helped put Hod Marshall in jail. I have managed to stay in touch with some of you but not as many as I had hoped. Those I know, are still pushing forward for justice and that is great.

    It is those of you I cannot reach I appeal to now. Especially those in Sudbury who did such wonderfully, terrible hard work so long ago trying to be heard. You WERE heard and need to be continue being heard. Do not falter. Everyone will be hearing from me soon and what I am doing – what I believe to be the right thing and the one most likely to produce justice and good results. I hope those in Sudbury are still doing the same off somewhere quietly but not forgotten.

    I have not forgotten you gentleman or the powerful impact you made in court, in our group, and in my life. I think of you all often and hope to hear from you. All of you – not just the Sudbury fellas. I encourage you all to get back out here and make yourselves known or pass something to me through Sylvia. She has all my contact information, all my trust and all my gratitude.

    I want to encourage those that have yet to go public with the clerical assaults that have plagued their lives to please come out and tell your story. It is tough to do. It took me 55 years to be able to tell my story and seek justice.

    When I gave my press statement last week and did my camera interviews for the media, I knew there were many of my old friends and associates from my career that would see the newcasts, read the newspaper and catch the news on the inernet. They would find out for the first time what I have hidden for so many decades.

    I didn’t know what to expect. I knew some would be shocked, not believe it and even perhaps, look down on what action I am now taking against those that protected Marshall.

    The result was nothing more than supportive. I received calls from and emails from many that I have not spoken to since I moved out of Windsor 21 ago. Maybe it’s my age group but, positive responses are what I am experiencing. Most that have made contact said they were a little reluctent to call. They thought maybe they should wait and give me time to unwind. They just couldn’t do it. They said they had to let me know they are on my side. Many that I spoke to were trying unsuccessfully to hold back tears.

    One couple that called were friends for more than 50 years. They were shocked. One of them told me that she was a victim of Fr. Sylvester. She had gone to her parents and they told her it was her imagination, not to bring the subject up again and to go to confession. That unfortunately was the response of many old Catholic families that KNEW THE CHURCH COULD DO NO WRONG.

    Sylvester’s numbers go far past the 47 that he was convicted of assaulting. The same is true of Marshall and the other villains that hide behind the Roman Collar.

    Again those that hold back on their announcement of their horriffic experiences are not doing themselves justice. We have to show where the real guilt lies.

    To all of you that have given your support to the victims of these crimes, I thank you and hope you will all continue to offer that support. If you know a victim and have yet to tell that person you are on their side, do it today. They will appreciate it. If I can help anyone take that step I would be happy to do what I can.

As we know, Hod was moved by his superiors, only to victimize more boys.     Stay strong people! Be aware you will not have total support. We were always afraid of the church Hierarchy! I was taught byand with Nuns, who should NEVER have been near children. Some were mean, angry women and I am sure damaged children emotionally! My mother, often spoke of the nuns in Ireland, who beat the children. I was physically hit, by the nuns at Windsor’ St. Genieve, for ‘talking’. Pray for victims of church abuse, to come forward and be counted. Thank you.

    How wonderful to hear from you Patricia. Family continues to amaze me!

    I appreciate your words and support. You are right that Hod abused so many children and he did it anywhere he could get away with it – anywhere they allowed him to get away with it until it became too difficult to accommodate. Then they moved him along to the next city, the next school. He and everyone like him must be exposed and this is one part of doing so.

    If you were abused and are ready to come forward, we are all here for you. If you know someone who was abused, just talk to them and offer your love. That is all they need. There are no “right words” that will come to you some other day that will never arrive.

    And (this has just occurred to me and I have never heard it spoken before) if you were one of the many who knew what Marshall and his like were doing, who enabled, who walked away, stayed quiet, pretended otherwise and so on ……. it is not too late to do the right thing. If you believe in the power and mercy of God, what is stopping your from speaking the truth right now?

    Has anyone heard anything regarding possible parole for Marshall? I want to know if there is any kind of parole hearing or anything like that in the near future. I would certainly wish to attend and/or be heard if such were the case. I don’t know how to track down that information or register to be notified. Does anyone know anything?

    It is the crowns’ duty to inform you when and if Marshall is up for parole. If you cannot get hold of the crown then try Victim, Witness Assistance it is also their job to help.

    Wow…just read the article about telling a priest in confession about Marshall.

    Once again this site explores all angles and possibilities that shows as well problems that exist within our Church. To be told “Say ten hail Marys” and to “growup! .”..and NOT mentionthis to a Bishop because of a code of silence in the confessional, is absurd. Or, did he mention this to the Bishop and NOTHING wass done??

    I will go as far as saying this. I truly believe if this was a woman priest in the confessional, things would have been handled differently. Or if confession was made to an Anglican priest who was a family man himself, things would have been done differently. The investigation would have started that daywith Marshall and perhaps many others would not be telling their horrendous story of abuse.

    Hindsight…..I agree…..but a valid statement all the same.

    The more I read this site the angrier I get.

    The bad news is that Marshall’s parole hearing has been postponed from Jan. 18, 2012 to March 27, 2012. His statutory release date is Oct. 08, 2012. He is now entitled to unescorted temporary absence and day parole. If you register, you will be given notice and are allowed to attend the hearing and give a statement. I know that is on my agenda.

    When a victim approachs a priest in a confessional for help and that priest uses the “code of silence” as an excuse for not offering help, he is as guilty as the sex offender. There is no code broken if the priest suggest he meet the victim outside the confessional or refers the victim to someone that can help. Failing to do that is just a another cover up by the church.

    Tomorrow there will be a press conference in Windsor regarding further civil suits against Marshall and those who enabled him during his four (five?) decades of abusing children. I commend those taking further actions against all those responsible just as I commend the two individuals who have brought charges against Marshall in Saskatchewan.

    I have followed Jerry’s suggestion above and am now registered with both the Parole Board and Corrections Canada. I would encourage all of Marshall’s other victims to do the same if they are so inclined. They will keep me informed of his status, location and any parole hearings – which I will be allowed to attend if I so choose. (And I will so choose!) Thanks Jerry for the information.

    Just to clarify … Marshall is not currently entitled to unescorted temporary absence, day parole or full parole. He is currently entitled to APPLY for these things whereupon a hearing would be held. He has applied for full parole and a hearing is scheduled for Mar. 27 having been postponed from the original January date.

    Undoubtedly the new charges in Saskatchewan have had something to do with the delay and may further delay the March hearing. I do not know. By registering with Corrections Canada any of his victims can be kept informed of these things

    The question now is how the new charges will play out and how to keep track of that.

    I hope the new charges it will be factored in the full parole hearing considerations as it speaks to his dishonesty they may consider that a lot more victims are out there and have not come forward. I wonder if we will ever know about the deals with the AG. That I find is the most awful disclosure of this case as it takes peoples rights away to seek out justice. I wonder if R Talach might consider putting together a victims registry and start a class action suit against the church… How many in Canada A Mari usque ad Mare.. I suspect in the thousands and many of these matters where obstructed in some manner or another. Should it not be considered criminal, if someone knew of the western charges and omitted to disclose knowing he was being prosecuted in Ontario.

    Hod entered his guilty plea in Windsor Ontario in June 2011. The complainants in Saskatoon came forward in July 2011 and a police investigation followed, with charges laid in Saskatchewan in February of this year.

I guess it should have read should it not be considered criminal if someone knew of his criminal activities in many placements and omitted to disclose the potential in those areas knowing he was being prosecuted in Ontario. Sorry bad composition day I guess.

    I have been trying to find out when Hod’s court date is on the Saskatoon charges. The last we heard arrangements were underway to set a court date in Ontario.

    Today I called the Crown’s office in Saskatoon to find out the date and location of Hod’s first hearing on those charges. I was told that the charges will not be dealt with in Saskatoon and that the entire file is being transferred to Ontario. I was unable to find out where in Ontario.

    My guess is Kingston, but, in truth, it could be anywhere in Ontario. I did try the Kingston courthouse – there is nothing booked in either the Ontario Superior Court or the Ontario Court of Justice. Apparently it does take time to transfer files from province to province – the package must first go to the AG’s office and then is sent out wherever.

    If anyone knows what is happening here please pass on the word. My one hope and prayer is that the transfer does not prohibit these charges from going forward.

    Hod’s parole hearing has been postponed again, this time to 30 May 2012 (original date was 18 January 2012, then 27 March 2012, now 30 May 2012). That means that he will stay behind bars for two more months.

    I have no word as yet on what is happening to the charges from Saskatoon, Sask. The files were transferred to Ontario. I, like Patrick (2012/02/15 at 2:50 pm), wonder if the delays in the parole hearing are related somehow to those new charges?

    Marshall’s parole review scheduled for May 30th has been cancelled and he has waived his right for further rerview. He can refile for another if he chooses but he will be released on October 8th. I just received my notification.

    While checking on Father Linus Bastien’s next court date I decided to see if per chance Father William Hodgson Marshall was on the Windsor roster.  He is.  He has a court-date at the Windsor Ontario courthouse 20 July 2012: 10 am, courtroom #7 “to take a plea.” (This would be on the sex abuse charges from Saskatoon, Sask, which were transferred early this year to Ontario)

    Hey Patrick…..I do hope that you or some others from up there make it to this hearing as I feel that something underhanded is being played out here. As you are aware, I have been pressing the AG’s office re: the deal that was given Marshall upon sentencing at your trial. They (the AG’s office) are refusing to answer my enquiries, beyond this…… “As I indicated in my July 28, 2011 letter to you, plea agreements are the result of privileged resolution discussions.   Resolution discussions between Crown counsel and defence counsel are by law privileged and confidential and thus I cannot comment.” (The AG’s quote).

    In my opinion, I think that the victims from Saskatchwen are being used as pawns so that WE percieve that justice is being done, when in fact it is making the new charges simple vanish. What I believe will happen is that Marshall will plead guilty and that he will be sentenced to…..whatever…..and that the sentence will run concurrent to his time that he is serving. So, in fact, a “perception” of justice.

    I have heard via the grapevine that one victim somewhere in Ontario has already been turned away by police, saying the no new charges can be laid. IF this is indeed the case then THEY (the AG) cannot even abide by their very own policy when they state in The Crown Policy Manual……2-”Public confidence in the administration of criminal justice is bolstered by a system where Crown counsel are not only strong and effective advocates for the prosecution, but also Ministers of Justice with a duty to ensure that the criminal justice system operates fairly to all: the accused, victims of crime, and the public.”

    So once again Patrick, I certainly hope that some of you from up that way make it for this hearing. I know for sure that I will be watching it VERY closely.

    Does anyone know what happens in cases such as this?  Is there an onus on the Crown to ensure the complainants can attend? or is the onus perhaps on defence/Hod to get them to Windosr, because seems to me this change in venue is for Hod’s benefit.

    When our case was going through the criminal justice process, the Crown Prosecutor told us the Crown was paying for all our expenses to get all of us to each of the 4 cities where he was being tried.

    IF things go as you say there should be opportunity for the victims to give Victim Impact Statements in Hod’s presence.  But IF this is all sewn up then what’s the point? There;s not much point in victims giving VISs to help the judge render a decision re sentencing if there’s been another  sweet deal hankered  out for Hod behind closed doors.

    I hope you still get there John so that you and all the others in Windsor area can try to find out what the heck is going on now.

    Hod’s “presence” as it were will be via video feed so he technically will be in attendance.  I know giving my Impact Statement last year necessitated his physical presence and it would not have been of any value to me otherwise.  I do not know if the victims from Saskatoon are coming.  I would think they would surely be given that opportunity though with Hod not physically present …..

    As best I know all the players involved (prosecutor, defense, Judge) are the same as his last trial.  I don’t know the time or courtroom but I would like to attend.

    It is scheduled for 9:30 am Friday in courtroom #7 on level 6 of the main court building.  (Not across the street like his first trial.)  Walter Costa will not be in attendance.  George Spartinos will represent the Crown, Andrew Bradie will continue to profit from pedophile priests, and Judge Dean will be delivering the sentence which will already have been agreed upon in advance.  So essentially he has nothing to do.

    Barring something unforeseen this whole exercise will change nothing regarding Marshall’s incarceration meaning he will get these two additional victims “for free”.  However, I will be there regardless.  Who knows ……. maybe justice will decide to make an appearance and something interesting will happen.

    As far as it not making any sense to give Victim Impact Statements when the sentence is already agreed – that is of course true.  But that’s the way it was the first time too.  The sentence was known going in and I certainly did not expect my Statement to change it as terrible as that is to say.  What purpose did Judge Dean listening to my, and all the others’, statements serve?  No purpose at all.  No purpose at all.  None.  Zero.  He could of put on headphones and listened to something else for all it mattered in the end.

    I gave a Victim Impact Statement for myself, for my family and friends, for Marshall’s other victims, for all other victims and possibly for the media as best possible.

    Just talking about this is upsetting.  18 months in jail for what will now be 19 (official) victims.  Marshall’s actions were criminal (among other things).  The results of our Justice System are revolting (among other things) but legal and seemingly accepted by us as a society.  Sometimes, when I think about that, I wonder where the fault truly lies.

In what seemed to be a surprise move Marshalls’ case was put over until Sept. 4th to be spoken to upon further information coming forward. I see this as a positive move, but I will speak to you Sylvia upon your return before I say more.

    There was an article in the Windsor Star the other day regarding Marhall’s release. It’s so considerate of the Parole Board to let him out a few days early so he did not have to spend Thanksgiving in prison. After all, he has much to be thankful for. He received a fraction of the time in jail he deserved. He is being provided with a comfortable retirement by the Basilians who have already given him cover for his crimes, tranferred him to meet new victims and have lied about their knowledge of his offences for more than fifty years.

    Yes, he has much to be thankful for. He will likely walk away from the Saskatchewan charges with “already time served sentence”. He will only show up for next session of his trial if he feels like it. When he does show up for sentencing the judge will be sure he is comfortable and address him with the same kindness he received the first time he stood before him.

    Nothing will change with the church’s support for him and other criminals. Isn’t is funny though that the pope’s servent received 18 months in jail for telling others of the corruption at the top of the church leadership and the protected criminal Marshall served 16 months.

    The  system and the church leave an awful lot to be desired,

    To those who continue to follow the Marshall cases, I applaud you. It is indeed a travesty and a  mockery. Never forget that it is the Roman Catholic Church employing the lawyers who use every opportunity they can unearth within our pathetic legal system to delay, impede and sidetrack justice. When the church tells the media of their concern for Marshall’s victims remember what they have said with their actions instead of their words.

    The man was already a convicted child molester sitting in jail when his Saskatoon charges came to court in July and then again in September. Were these repeated delays and expenses necessary for the proper administration of justice? Were they done for the benefit of the victims? Or were they done for the benefits of the lawyers, the criminal and his protectors?

    I had hoped to have had something in print in advance of this next court date as anyone who cares about children, the administration of justice, sexual abuse, proper use of tax dollars, or the true church of the people and the teachings of Jesus Christ should be at court tomorrow demanding to be heard. Alas, such was not to be and I myself will be unable to attend. Know that I am there in my heart and hoping against hope for some justice to be done and to be seen. We shall see.

    I am sorry I cannot join those of you who will attend but I would love to see any who choose to spend the day. My best to you all; you are doing what is right and what need be done.

      As expected, absolutely NOTHING happened today in courtroom 10 at the Windsor courthouse re: Marshall. I don’t know if any of you have ever flicked a bobblehead doll on the forehead to watch it nod yes, time, and time, and time again. Marshalls’ lawyer (Andrew Brady) flicked Judge Deans’ forehead and was able to get him to nod YES, time, and time, and time again. A new date has been set (Oct. 31st) to set a date for disposition, which should mean in the english language; the final settlement of a matter. Only lawyers and judges know what disposition means in legal terms.

      I had a chance to speak with the Crown that had handled previous appearances, although he was not in the courtroom today. I caught him in the elevator on our way up to the sixth floor and Cathy and I rode the elevator down with him and then spoke in the hallway. I asked him; Why (according to his previous answer as to why the case is in Ontario, which is only for Marshall to plead guilty) are there ANY delays at all in this case, when it is supposed to be so simple? And: Why is this case costing Ontario taxpayers any money at all with these delays? His answer was…Because our system allows it to happen.

      I then asked him; Has Brady waived his clients’ (Marshall) 11b rights? His answer…..All delays so far have been Bradys’. I told him that I have been down that road before, and that pointing the finger at who owns the delays is open to Judge Deans’ interpretation, at which I was slightly scoffed at.

      Gary I am now going to speak directly to you and whoever else has charged Marshall. I URGE YOU, BEG YOU, AM PLEADING WITH YOU to contact the Crown Attorney in Windsor (his name to follow) and put these questions and ANY OTHER questions that you guys may have to him. This is your case that is being played with here in Ontario. You gentlemen are owed justice on these charges.

      It was great to meet up with Cathy, Jerry and now Mike today in Windsor. I don’t know if I will be making it to the next appearance, it is short notice to try to arrange for time off again, BUT I will do my best.

        Thanks for the news John. No surprise we have another date I suppose, but a little part of me keeps hoping for something better 🙂 So, as it stands, another date top set yet another date? How much is this costing I wonder? I know it costs taxpayers money to send a Crown into the courtroom. And it taxpayers costs money to use the courtroom and all the staff. Not cheap.

        As for Mr. Brady, his attendance in court – and all preparations, costs the Basilians money. That perhaps is a non issue? Where I wonder do they get the money to play this out to the Nth degree ?

        And, of course, there is the cost to the victims – that’s a cost which we can not truly put a $$$ figure on, but I can not help but feel for those men in Saskatoon who have been cut out of these proceedings entirely. Is this just? Is this it justice? It may work out quite nicely for Mr. Andrew Brady and Father William Hodgson Marshall, but what about the victims? (Yes, I do say victims because my understanding is that the deal/agreement was that hod would plead guilty if the charges were transferred to Ontario.)

        I am disappointed to hear that Justice Dean is on the bench for these charges too. It was Justice Dean who thought that two years for sexual abuse of 17 victims was an appropriate sentence for hod Marshall.

        Nice to hear the four of you got together. I’m sure Patrick would have loved to be there with you. Me too!

    *I’d like to thank everyone that’s put so much effort into this. I’ve not ever been silent on this matter and have told everyone when oppertunities arose. Of course that speaking out started happening several years after high school and only when reports of these crimes started being common. I never thought ANYTHING legal would happen and only after he was charged in Ontrio did we decide to go to the newspaper and then the police to report what happened here. Jason Warick (reporter) and Carolyn Hnady(saskatoon police)were both outstanding. I was the most upset with all the other priests who were complicit especially the one who I latter learned heard all about it in confession. Perhaps the most damning of all is the Church’s  current hypocrisy in hiring lawyers to obfuscate while telling everyone how truly remorseful they’ve become.

I am sure he had to stop at the bank with another Basilian cheque. He seemed to be in a hurry to leave and gave us all his normal sneer on the way out. He should be thanking us for the fortune he is making in defence of vermin like Marshall.

    The system is garbage. Justice is not served and concern for victims is not part of the agenda. They are more worried about the cost of keeping Marshall in jail than the cost of the proceedings that let him loose. His restricted parole is of no consequence to him nor satisfaction for any of those he has violated. I thought the justice system was designed to punish the offenders, not consider what future harm he might so to others.

    Aside from meeting Mike for the first time and seeing Cathy and John again, one of the nicest moments of the day was when I called officer Gus Levesque who accepted and processed the charges against Marshall. He came over to the courthouse to give us his regards and to meet with the other victims that were there.

    With all the negative police news out there it is great to see an officer who really cares about victims even past the demands of his job.

    I will be going back on the 31st even if it is another 4 minute joke. If there will be final disposition or just setting a date for it we should be prepared. If Dean gives him another slap on the wrist we need to have some media coverage showing the outrage that society should have for the light punishment of such live changing crimes.

    I hope the victims from Saskatewan see some justice out of all of this. They should be given the opportunity and funding to attend at least the final sentencing.

    Again, support is a contiuous need for all. The healing process takes a long time.  Friendship and understanding is certainly an essential ingredient.

         This will NOT be short! I have sooo much to share with you, so please be patient. I have been told by so many people that in the midst of adversity, there is always good to be found. One only has to look for it. Well, I have spent a major portion of my life NOT looking for it, purely because of my own insecurities, guilt, shame, and personal selfishness and cynicism. Well, yesterday that all changed!
         My “rant” is in two parts. The first part will cover the proceedings yesterday in court in Windsor Ont. The 2nd part will cover the activities  and thoughts of the 24 hours that followed.
         I am deeply disturbed and vexed by the charade I witnessed in court yesterday. Let me preamble by saying that this was my first experience at being in a criminal courtroom to witness a hearing on a criminal sexual assault. What I expected to see was NOT what happenned! My impression was that the entire staff of players in this Marshall case (excluding the REAL victims) was that theydidn’t seem to take this matter seriously at all! The Judge wore a grin through the whole minute that this “hearing” took place. The defence counsel appeared as a dour, miserable creature who, like Jerry said, couldn’t wait to get out of the place, run across the street to the bank, and cash in his latest cheque from the Basilians. The CA sat in his chair like Larry the Cable Guy in a most unprofessional pose, and seemed to be completely disinterested in the proceedings. The whole thing had obviously been orchestrated behind closed doors long before we mortals appeared on the scene in the bleachers, waiting for the “play” to play out.
         I feel this court hearing had the aura of traffic court, and that they were dealing with nothing more serious than a delinquent parking ticket!
         I feel so bad for the victims of this sad, twisted creature. I hope you people in Saskatchewan realize that even if the “justice” system doesn’t appear to be behind you, WE ARE! and we will continue to be.
         Apart from the above, it was a truly WONDERFUL day for me. Meeting Jerry, Cathy, John, and Gus put a personality to the faces I have only up to now seen on TV or in a newspaper. I want to single each one of you out, but I don’t think this is the venue for that.  I hope each one of you will realize how much of an impact you made on me. Sitting there having breakfast together (thanks Cathy) sharing our stories, feelings, ideas, advice, and tons of REAL laughter made me feel like I was having an intimate breakfast with my very own family. I also now understand that I am not alone in this, and I need not feel any further shame and embarassment over my own case of abuse.
         I feel this could be the start of a friendship that will last a lifetime. Our common bond will ensure that the fight against this plague will continue, and yield successes!
         I personally owe Sylvia a debt of gratitude. If it wasn’t for her and her site here, I would never have met such wonderful people, and I look forward to seeing you al again soon. I just wish it could have been in better circumstances.
         Now please stay tuned for my next segment. I would like to share with ALL of you how the adversity of this day changed me, and FORCED me to see the good in it. I assure you at the very least that you will chuckle, if not laugh hysterically, at how MY day in Windsor went, and how it ended up back in the bright lights of Oshawa Ont.    Mike

    * Okay all, here we go! This isn’t short either. My trip to Windsor started at 0500. I arrived home at about 4:30, had a quick shower (yeah, no shampoo Jerry) and mounted my trusty Toyota-steed and made tracks for Windsor. I arrived in great haste for I was late, and after circling the block a couple of times, found a most appropriate (and vacant) parking spot into which I deposited my Toyota rather unceremonially, and rushed into the courtroom to meet you guys.
         After the court charade was done, we had our breakfast meeting (chronicled above) and we left to go our separate ways. John and I walked out together ( I admitted to him I didn’t know how to get out). Upon reaching the street, I had to admit to John also that I really wasn’t sure where I had left my car. He handled it really well with just a SMALL grin. I told him that all I could remember in my haste was that there was a little church behind the parking lot. He led me right to it! There it was! My Toyota-steed right where I had left it. John and I bid each other farewell, and I headed to my car. (in the next few moments I was really wishing that John had not left)
         Got in the car, adjusted myself and turned the key……………………………………….! Nothing, zero, zilch, nada, my trusty Toyota is VSA, it is beyond surgery, it is DEAD. Okay, at this point you have to realize that I have spent the last 40 years of my life not being able to channel or deal with anger appropriately, alright? We’ve (victims) all been there. So I start looking around for my communications device (cell phone, that is) and during my search of my dead car, I notice a little slip of paper stuck under the windshield wiper. I get out, and guess what? Yep, you’re right! It is a little neatly printed certificate made out to me personally, and advising me that I have really pissed-off the City of Windsor by parking in this very spot! For a paltry sum of 20 dollars of my hard earned cash, I can ease the turmoil I have caused this great city!
         Oh, the indignity of it all! Okay, I hold it all together, get back in my dead car in a strange city, and resume a very earnest search for my communications device. Aha! there it is, on the floor of the passenger-side, right where I left it! I pick it up, and commence dialing CAA (whom I have not called in over 7 years) I start to realize at this point that my communications device is not making it’s usual beeping noises! I look closely, and guess what? Yep, you’re right again. It is beyond helping me. Vital Signs Absent! I’m sure you can now guess where my charging cord is, eh? Yep, right back at the house in Oshawa Ont.
         I can feel the anger building by the moment, and I don’t even want to see the end result of this, so what’s a man to do? I have a dead car in a strange city, my cell phone has failed me, the City of Windsor hates me, God hates me, and all my new friends have abandoned me for their own homes. I get out of the dead car, hitch up my pants, take a deep breath, puff up my failing chest, and stride into the nearest building that looks like a functioning communications device might be present. Guess what? I have walked right into the Administration Offices of the City of Windsor! I walk up to the counter and ask the dear lady if I could use THEIR phone to call MY CAA to retrieve MY car from THEIR parking spot which I, in my haste, had so rudely appropriated illegally. She gives me a phone, and I make the call. CAA assured me that they would be there within the hour. I turn to leave after thanking the lady (I just wanted out) and then she says it! Would “sir” like to consider making a 20 dollar cash donation to the City of Windsor, thereby negating the necessity of the City having to send me a legal summons in the mail? Realizing that the dear lady was being very honest, helpful, and rather earnest, “sir” decided to make that donation to easse the turmoil the City of Windsor was feeling at that moment.
         I ran out of the building now assured that not only God and the City of Windsor hated me, but now Satan himself was on my heels!
         For the next 3/4 of an hour, “sir” paced in a tight circle like a frustrated dog on the side of University Ave., alternately laughing and crying at his predicament.
          Finally, CAA arrived. I am most grateful to the powers that be that this was a young man, and he had a sense of humour. I informed him that the idiot that had driven me from Oshawa to Windsor (that would be me) had in his haste neglected to turn off his headlights after so rudely expropriating the City of Windsor’s only spot in this lot. This was the turning point, because the young man broke out into hysterical laughter! I had no other alternative but to laugh with him, because he was a BIG boy, and to have expressed any anger towards him at that moment would not have bode well for me.
         He breathed new life back into my Toyota-steed (I now call it Lazarus) and I was on my way back to the bright lights of Oshawa Ont.
         Now I suppose you think that’s it, right? Nope, don’t leave yet, there’s more.
         My fingers are cramping so I’m gonna lie to you now. There is actually 3 (three) parts to this. Stay tuned.     Mike

         Okay, fingers working again (for a short while). I arrive back home about 6:30 pm. At this point I have been up and going for 48 hours, so you can understand me when I say that I just laid down on the bed “for a few moments” to rest my eyes, in anticipation of “lovey” (my new lovely wife of 3 years) returning home. I fell into what I call a deep sleep. Apparently, lovey arrived home from her shop around 9 pm, and found me in a “clinically comatose state”. Her efforts to arouse me (wake me up, that is, okay) were apparently unsuccessful, so she abandoned her efforts to bring me back to life, had her bed-time snack and curled up beside me and fell asleep.
         My next recollection is sitting bolt-upright in our bed, laughing loudly and hysterically at 2:30 in the morning (yes, I looked at the clock) over some stupid dream I was having about parking tickets, dead batteries, etc. At this stage I was nonplussed to realize that I was not the only one sitting bolt-upright in our bed! Lovey was also sitting bolt-upright in bed, and she was NOT laughing. She was looking at me with horror written all over her face, eyes wide, mouth hanging agape, and asking me what was wrong. My assurances (between peals of laughter) that all was well was falling on deaf ears.
         What followed was a 30 minute “Examination for Discovery” the likes of which Robert Talach has NEVER seen! Finally lovey began to figure out that all was indeed well, and with a rather lame grin, and a grunt with distinctive male overtones, she dismissed me, rolled over and went back to sleep.
         So ended my trip to Windsor Ont. Lovey indicated to me this morning that she would really like to meet all these people that I was mumbling about in the wee hours. Yep, she already knows all of you! Cathy, John, Jerry, and Gus. I think my 0230 rantings have scarred lovey indelibly for life!!! (just kidding)

      Mike…….Please excuse any and all typos. Do you realize how difficult it is to reach up from the floor and type as you are rolling around laughing your ass off? It is no wonder NOW why I didn’t see you at the first ONroute on the highway LOL. I waited about half an hour, from your words it would have meant me waiting a lot longerrrrrrrrrrrr. Sorry to hear about your trials and tribulations, but as I often say EVERYTHING is a learning lesson. Once again my friend, welcome to this side. Like I said, now that you are here there is no turning back. As James would say during his hauls……Keep consulting that idiot Mike!!!! I think that you are in the wrong profession, you do belong on the road, but on the stage.

    Thanks JG!  It sure was a turning point for me. I hadn’t realized so deeply that all these years I had spent ranting, railing, and wallowing in my self-pity were really leading me to my own destruction.
        Meeting my friends in Windsor was a real catalyst! Seeing how Jerry and John have survived these horrible things should be an inspiration to us all. Not to mention the absolute dedication of one Officer Gus Levesque of the Windsor Police Service, and Cathy, retired school teacher, a warm and very caring person!
         It is my hope that in all of this adversity, we will meet one day JG, and laugh our guts out together!    Mike.

    Mike, you had me in stitches!  Not a great day for me – I was castigated this morning for having Father Joe LeClair’s name on Sylvia’s Site.  I arrived home to home to carry on painting, a stucco ceiling!  I’m not the best painter in the world at the best of times – a stucco ceiling was a new challenge.  Well,  the ceiling is painted – so am I, the step ladder and virtually every inch of plastic I used to cover the computer and desk.  

    What fun to read your blogs 🙂  You had us right there with you.  What a gift to be able to laugh at it all, and to laugh at yourself, and let us in to laugh with you 🙂 🙂

    Is anyone heading for Windsor on the 31st? After all, it is holloween. I understand if Marshall is there he will dress up like a priest that cares. Dean will dress up like a Judge that believes in justice and the Crown will just be wearing his normal smile, if he can find one. Brady will be giving out candies to little boys and giving their addresses to Marshall.

    It will be a valuable use of our taxes watching the thousands of dollars being spent for thirty seconds of court time.

    Having said that, I will be there. I hope others will attend and at least we can share a lunch.                     It won’t be Cathy’s turn to buy.

    Jerry posted his comment here, under “More charges laid.”  That little * is just there in the software “plugin” and I do believe causes confusion.  As many of you have discovered, when you blog you can delete the * – no harm done and it’s out of the way.  However, if you start to blog and change your mind that darn little * will wind up posted as a comment.  I usually just delete those, but sometimes miss.

    Catch the Windsor Star article in today’s paper. Defrocked Godwin Scerii was convicted in 2011 along with two other priests there on rape and sexual abuse charges. He ran away from the charges laid in the Windsor area back in the 1990s. Another example of the Church aiding and abeting their criminal vermin. They should all be put in jail.

I’ve never been able to hit the reply feature under someone’s name. Could be because I use a Mac, I don’t know. Anyway, thanks for clarifying it. I usually comment on those asterisks because there are some who just use it to indicate their displeasure at something we regulars post. It’s just a habit I have. Take care.

      I have disabled a plug-in which allowed users to italicize and bold and so on when posting a comment. That opens up the ability to reply directly to a comment. I added this plug-in a long time ago thinking that the ability to have more control over posting comments was something which people would want. It’s a long story, but I believe what happened is when the WordPress software upgraded it created a conflict with the plug-in, hence the inability for most people to reply directly to a post. That seems to be related to a browser you are using. I have done some testing on various browsers.

      Anyway, I have disabled the plug-in – everyone should now be able to reply directly to a comment, BUT the sacrifice to regain that ability is loss of ability to italicize or bold your comments. I don’t know which people would prefer. I personally preferred the old old version where comments were numbered, bu that went by-the-bye with an upgrade 🙁

      Please let me know if this does the trick for you, and if you prefer that I leave it this way.
