Le prêtre, aujourd’hui âgé de 75 ans, fait face à deux chefs de grossière indécence et trois autres pour attentat à la pudeur.
« C’est un jour triste », a commenté l’évêque du Diocèse de Chicoutimi Mgr André Rivest lors d’un point de presse.
« Ce que je peux vous dire, c’est que l’Église du diocèse prend très au sérieux cet événement », a-t-il ajouté en précisant sa compassion à l’égard des victimes.
À la retraite
Paul-André Harvey a été ordonné prêtre en 1962. Les faits qui lui sont reprochés remontreraient à la fin des années 1960 et auraient été commis à Kénogami.
Certains gestes auraient été posés entre le 29 avril 1966 et le 28 février 1969. D’autres actes auraient eu lieu entre le 1er janvier 1967 et le 28 février 1969.
Les victimes sont aujourd’hui âgées dans le début de la cinquantaine. Le prêtre a pris sa retraite en 2002, mais le diocèse précise qu’il exerçait toujours un ministère de remplacement à l’intérieur de résidences funéraires.
Mesures imposées
Le diocèse a été mis au courant de l’enquête policière qui ciblait Paul-André Harvey, le 20 septembre 2011. Mgr Rivest rapporte avoir immédiatement pris les mesures qui s’imposaient.
Il a exigé que le prêtre cesse d’exercer son ministère, qu’il n’entre pas en contact avec les plaignantes et qu’il ne se trouve pas en présence de mineurs.
« Ça confirme qu’ici au diocèse, c’est tolérance zéro », a appuyé Mgr Rivest. Il ajoute que c’est par souci de transparence qu’il a pris cette décision.
« C’est par prudence. Cela illustre le soin que l’on veut prendre d’éventuelles victimes, ce n’est pas pour le condamner ».
Le principal intéressé a signé un document, le 19 octobre dernier, afin de s’engager à respecter les mesures imposées par le diocèse.
L’abbé Émilien Dumais, vicaire général au diocèse, a rencontré Paul-André Harvey lors de cette signature. « C’est quelqu’un qui était bouleversé, peiné et qui se demandait comment il allait survivre à ça », a rapporté l’abbé Dumais.
Deux autres prêtres du diocèse de Chicoutimi se sont retrouvés dans pareille situation en 1992 et 2002, rapporte Mgr Rivest.
L’Évêque du diocèse a précisé qu’un protocole d’action a été mis en place en 1994 afin de protéger les enfants de toute forme d’abus de la part des prêtres, diacres ou agents de pastorale.

La Presse is reporting that there had been many alarm bells regarding Father Harvey as well as letters to the Diocese that were unanswered. And Father Harvey was indeed
conveniently moved from one parish to another whenever new rumors concerning his criminal activity started regarding him. So Father Harvey got away with it for so long because he had enablers at the Diocese. Enablers and clerical peers who were either perverts (and Father Harvey could leverage their dirt) and/or cowards. I don’t believe for a minute that Father Harvey’s plea was designed to preserve his victims from the ordeal of trials. I believe that Father Harvey waited so long in the hope that key witnesses against him would die before the trials began.
This morning, inmates at Federal institutions are reading that Father Harvey would tell his victims to not disclose the abuse to anyone because it would make the little baby Jesus sad. Myself, I sincerely don’t believe that Jesus would actually mind if Father Harvey would get the ying-yang banged outta him while he’s incarcerated.
I know certainly wouldn’t.

I support that action. The faithfull in Chicoutimi need to know the names of the clergy who covered-up for Father Harvey. They need to be exposed as cowards. Hopefully Father Harvey will allocute to these cowards as he seeks to make his sentence more comfortable. Given that Father Harvey has the dirt on his own peers at the Diocese of Chicoutimi, it’s foreseeable that it will race to defrock Father Harvey to dissociate itself with him as soon as possible.
Personnally I don’t think that Father Harvey’s sentence is proportional to the damages he has caused – although serving six years as a convicted child molester is no walk in the park. Even in protective custody and under a suicide watch for the first months of his sentence, Father Harvey will have to eat… and the other inmates working in the kitchens will serve him his sentence… in his food tray. Protective custody may sound safe for the non-initiated; but it really means that you’re not eating with the general population and that if you are a child-molestor you will be (literally) eating s— and/or die while incarcerated. The guards will be explaining it all to Father Harvey in due time and he’ll be reminded at least three times a day what it means to not be able to trust anyone anymore.
I feel very vey sad for Father Harvey’s victims. Many of them were innocent Girlguides that had been entrusted to Father Harvey.

In this class action, the Diocese of Chicoutimi and it’s civil liability insurer are involved in a battle because in 2013 as the liability insurer foresaw that a civil aciton would ensue following the laying of charges against Father Harvey the maximum coverage for the Diocese of Chicoutimi dropped to 2 million per abuser. The Diocese is alleging that it’s insurer, l’Assurance Mutuelle des fabriques de Québec which specializes in Church insurance matters reduced it’s special coverage for clerical abuse to avoid having to pay damages to victims of Father Harvey. The diocese believed that it was covered up to 20 million dollars to pay for damages to the victims and since this class action is claiming damages of 14 million it believed that it was sufficiently covered.The class action now includes 92 plaintiffs. The lawyers for the plaintiffs who won a landmark civil action against big tobacco in 2015 are considering going after the Holy See should they succeed in this action.
Is this currently being fought in court BC?
The Diocese of Chicoutimi had filed a complaint with Québec’s Autorité des marchés financiers last year in 2017. The AMF is Québec’s financial/insurance regulator. Legally speaking it is an administrative tribunal and so before this matter is finally adjudicated it could take years because administrative tribunals are subjected to judicial review in Canada i.e. this case could go to court if one of the parties challenges it’s decision. I haven’t read the briefs of neither the Diocese of Chicoutimi nor la Mutuelle des Fabriques (transl: parish council mutual – insurance) The Diocese’s special coverage for clerical abuse was modified from a maximum of 10 million per year to 2 million per clerical abuser and only for cases which occurred after 1995. That means that actuaries have determined that an insurance product which would cover clerical abuse occurring prior to that year would not be profitable. The Diocese claims that it only found out about the changes after Father Harvey was convicted and the civil action for vicarious negligence ensued. The victims group was offered 2 million as per the terms of the policy. But they are suing for 14 million. In fairness to the liability insurer; I would be (extremely) surprised if those insurance contracts didn’t contain clauses which voided coverage for clerical abuse if the Diocese contributed to a clerical abuser’s negligence (by covering-up for him) or for withholding vital information from the liability insurer which could prevent it from reasonably knowing the actual risks involved.
For these reasons, although the media hailed Father Harvey’s disclosure as being good for the plaintiffs, I doubt it myself. If those insurance contracts (with their limitation clauses) are to be considered legit then Father Harvey might have abused of his victims one last time, by triggering the limitation clauses. I like to believe that the Diocese of Chicoutimi is acting to ensure that Father Harvey’s victims will be duly compensated; but the bigger picture is obviously that virtually all parish councils and dioceses now know that their own civil liability insurers will not stand by them in cases of clerical abuse cases. And that’s good news; because the Church will have to reduce it’s exposure to litigation; one way or another.
A class action involving the victims of Father Harvey now names the Bishop of Chicoutimi as a defendant. Nine parishes are being sued: Saint-Dominique, Sainte-Famille, Saint-Philippe de Jonquière, Sacré-Coeur de Jésus, Notre-Dame-de-la-Paix, Saint-Joseph, Saint-David, Saint-Gabriel-Lalemant de Ferland-et-Boilleau, Saint-Alphonse; as is their civil liability insurer L’Assurance mutuelle des Fabriques du Québec.
