A priest accused of sexual assault in Saguenay

Le Reveil

A story of a priest accused of sexual assault undermines the Diocese of Chicoutimi. Paul-André Harvey was accused on Thursday of five counts of sexual nature. Between 1966 and 1969, he would have three victims. (Photo: Daniel Gauthier reproduction)

A story of a priest charged with sexual assault undermines the Diocese of Chicoutimi. Father Paul-André Harvey was accused on Thursday of five counts of sexual nature. Between 1966 and 1969 he would have three victims, all three under the age of ten years.

The priest, now aged 75, faces two counts of gross indecency and three for indecent assault.

“It’s a sad day,” said the Bishop of the Diocese of Chicoutimi Bishop André Rivest during a press briefing.

“What I can tell you is that the Church of the Diocese is very serious event,” he said indicating his compassion for the victims.

In retirement

Paul-André Harvey was ordained priest in 1962. The facts alleged against him remonstrating in the late 1960s and have been committed Kénogami.

Some actions have been taken between April 29, 1966 and February 28, 1969. Other acts have taken place between 1 January 1967 and February 28, 1969.

The victims are now aged in their early fifties. The priest retired in 2002, but the diocese said he still exercised a ministry of replacement within the funeral.

Measures imposed

The diocese was made aware of the police investigation that targeted Paul-André Harvey, September 20, 2011. Bishop Rivest reports that it immediately took appropriate action.

He demanded that the priest ceases to exercise his ministry, he does not come into contact with the complainants and that is not in the presence of minors.

“It confirms that here in the diocese is zero tolerance”, supported Bishop Rivest. He added that the interests of transparency that has made this decision.

“It’s a precaution. This illustrates the care that we want to make potential victims, not to condemn. ”

The main interest has signed a document on October 19, to commit to the measures imposed by the diocese.

Father Emilien Dumais, vicar general of the diocese, met Paul-André Harvey at this signature. “This is someone who was upset, saddened and wondered how he would survive it,” reported Father Dumais.

Two other priests of the diocese of Chicoutimi found themselves in a similar situation in 1992 and 2002, says Bishop Rivest.

The Bishop of the diocese said that a memorandum of action was established in 1994 to protect children from all forms of abuse by priests, deacons and pastoral associates.

Father Paul Andre Harvey’s court date tomorrow in Chicoutimi is at 09:30 am in courtroom #210.

  2. Sylvia says:

Father Paul-Andre Harvey’s next court date is:

27 August 2013,: 09:10 am, courtroom 9.5, for preliminary inquiry, Chicoutimi courthouse, Chicoutimi, Quebec

Here again I, who speak not a word of French, was speaking to a very pleasant and helpful clerk who speaks a little English. I know start time of 09:10 sounds strange, as does courtroom number 9.5, but we went over both of those details to ensure i understood what she was saying, and she was comfortable with the English translation. The most important thing however is that the date is correct, and of that I am sure 🙂

Father Paul Andre has been committed to stand trial. He has opted to be tried by judge alone.

Another 11th hour GUILTY plea, this tiem from Diocese of Chicoutimi priest Father Paul-Andre Harvey:

16 June 2015: Paul-André Harvey, retired priest, pleads guilty to dozens of sex-related charges

Does anyone for a moment believe that it took Father Harvey three years plus to know that the he had sexually abused those girls?

Why did he not do the honouarble thing and acknowledge his guilt and crimes when the victims first came forward?

I will never understand a system which will now without doubt give this priest kudos for sparing his victims the horror of testifying at trial?

How have we come to this?

What of the horror the victims have endured for the past three years? Why did he not admit his crimes immediately and thus spare his victims three additional years of anguish ?

By failing to admit to his crimes immediately Father Harvey opted to put these women through three years of Hell on earth. I know, it’s legal. That’s the way it’s done. I, however, have trouble with it, be it done by a Father Harvey, or a Father Sullivan, or a Father Marshall, or Father Whomever.

I wonder has the Bishop of Chicoutimi has, as he should, started the process to have Father Harvey defrocked?

Anyway, a guilty plea. A relief I am sure for Father’s many victims. Please keep them in your prayers .

    • BC says:

… and now the Bishop of the Diocese of Chicoutimi André Rivest is now representing that neither his predecessor Bishops nor any member of the clergy in that Diocese ever knew about their good friend/brother/peer/collegue and one of Canada’s most active serial rapist Father Paul-Andre Harvey.

40 victims. That’s thousands of people in terms of families, relatives and friends. But the Diocese of Chicoutimi and it’s outstanding charitably humanitarian clergy never heard about Father Paul-Andre Harvey.

I do not believe the Bishop of the Diocese of Chicoutimi André Rivest.

All the pervert collars you mention have or are doing this. And under the approval of collars authorizing the payment to defend them. I applaud all who come forward and continue to fight that church on it’s defence of these pervert collars…thanks Sylvia for giving us a website that permits us to continue voicing our concerns.

  5. PJ says:

Right on Sylvia! That church, its enabling supporters and pervert collars would rather pay huge dollars to deny, defend and denigrate to put the victims through hell. I hope many of these victims continue with charges and lawsuits to hit that church on what it worships the most…the almighty dollar.

  6. BC says:

La Presse is reporting that there had been many alarm bells regarding Father Harvey as well as letters to the Diocese that were unanswered. And Father Harvey was indeed
conveniently moved from one parish to another whenever new rumors concerning his criminal activity started regarding him. So Father Harvey got away with it for so long because he had enablers at the Diocese. Enablers and clerical peers who were either perverts (and Father Harvey could leverage their dirt) and/or cowards. I don’t believe for a minute that Father Harvey’s plea was designed to preserve his victims from the ordeal of trials. I believe that Father Harvey waited so long in the hope that key witnesses against him would die before the trials began.

This morning, inmates at Federal institutions are reading that Father Harvey would tell his victims to not disclose the abuse to anyone because it would make the little baby Jesus sad. Myself, I sincerely don’t believe that Jesus would actually mind if Father Harvey would get the ying-yang banged outta him while he’s incarcerated.
    I know certainly wouldn’t.

Foreseeably, someone is a-gonna come along here once again to claim that Father Harvey is a great humanitarian who was tempted by evil little girls. And we’re gonna be reading from the Diocese of Chicoutimi about the greatness of their commitment to protect vulnerable persons.

  7. BC says:

Father Harvey of the Diocese of Chicoutimi was sentenced to serve a six year sentence this morning.

  8. BC says:

One of Harvey’s victims; Suzanne Tremblay, states that other members of the clergy in Chicoutimi knew of Father Harvey’s crimes and physically intimidated her into silence. Given the number of Father Harvey’s victims I believe Suzanne Tremblay that other clerical members of the Diocese of Chicoutimi knew. It’s gonna be all too convenient for the Diocese of Chicoutimi to attempt to end this story with Harvey’s sentencing. There has to be a civil action against the Diocese of Chicoutimi for it’s vicarious liability in allowing Father Harvey to prey on innocent and vulnerable children and that is what Suzanne Tremblay is indicating that she’ll instigate. I support that action. The faithfull in Chicoutimi need to know the names of the clergy who covered-up for Father Harvey. They need to be exposed as cowards. Hopefully Father Harvey will allocute to these cowards as he seeks to make his sentence more comfortable. Given that Father Harvey has the dirt on his own peers at the Diocese of Chicoutimi, it’s foreseeable that it will race to defrock Father Harvey to dissociate itself with him as soon as possible.

Personnally I don’t think that Father Harvey’s sentence is proportional to the damages he has caused – although serving six years as a convicted child molester is no walk in the park. Even in protective custody and under a suicide watch for the first months of his sentence, Father Harvey will have to eat… and the other inmates working in the kitchens will serve him his sentence… in his food tray. Protective custody may sound safe for the non-initiated; but it really means that you’re not eating with the general population and that if you are a child-molestor you will be (literally) eating s— and/or die while incarcerated. The guards will be explaining it all to Father Harvey in due time and he’ll be reminded at least three times a day what it means to not be able to trust anyone anymore.

I feel very vey sad for Father Harvey’s victims. Many of them were innocent Girlguides that had been entrusted to Father Harvey.

  9. Sylvia says:

Thanks ‘just a victim’ and BC for keeping everyone updated regarding Father Harvey’s sentencing. I have just posted two articles – both in French with the typical Google translation, but enough to give us the gist of the originals.

Here is a link to the articles:

11 September 2015: “Crimes of sexual violence on children: Fr. Harvey sentenced to six years in prison” google translation & related article

Well done Suzanne Tremblay and all you other victims who found the courage to come forward and and finally have this “priest” identified as the wolf in sheep’s clothing that he is.

And, good news too to read that the Chicoutime Diocese has initiated the process to have Harvey defrocked.

  10. BC says:

In this class action, the Diocese of Chicoutimi and it’s civil liability insurer are involved in a battle because in 2013 as the liability insurer foresaw that a civil aciton would ensue following the laying of charges against Father Harvey the maximum coverage for the Diocese of Chicoutimi dropped to 2 million per abuser. The Diocese is alleging that it’s insurer, l’Assurance Mutuelle des fabriques de Québec which specializes in Church insurance matters reduced it’s special coverage for clerical abuse to avoid having to pay damages to victims of Father Harvey. The diocese believed that it was covered up to 20 million dollars to pay for damages to the victims and since this class action is claiming damages of 14 million it believed that it was sufficiently covered. The class action now includes 92 plaintiffs. The lawyers for the plaintiffs who won a landmark civil action against big tobacco in 2015 are considering going after the Holy See should they succeed in this action.

  11. Sylvia says:

Is this currently being fought in court BC?

  12. BC says:

The Diocese of Chicoutimi had filed a complaint with Québec’s Autorité des marchés financiers last year in 2017. The AMF is Québec’s financial/insurance regulator. Legally speaking it is an administrative tribunal and so before this matter is finally adjudicated it could take years because administrative tribunals are subjected to judicial review in Canada i.e. this case could go to court if one of the parties challenges it’s decision. I haven’t read the briefs of neither the Diocese of Chicoutimi nor la Mutuelle des Fabriques (transl: parish council mutual – insurance) The Diocese’s special coverage for clerical abuse was modified from a maximum of 10 million per year to 2 million per clerical abuser and only for cases which occurred after 1995. That means that actuaries have determined that an insurance product which would cover clerical abuse occurring prior to that year would not be profitable. The Diocese claims that it only found out about the changes after Father Harvey was convicted and the civil action for vicarious negligence ensued. The victims group was offered 2 million as per the terms of the policy. But they are suing for 14 million. In fairness to the liability insurer; I would be (extremely) surprised if those insurance contracts didn’t contain clauses which voided coverage for clerical abuse if the Diocese contributed to a clerical abuser’s negligence (by covering-up for him) or for withholding vital information from the liability insurer which could prevent it from reasonably knowing the actual risks involved.

For these reasons, although the media hailed Father Harvey’s disclosure as being good for the plaintiffs, I doubt it myself. If those insurance contracts (with their limitation clauses) are to be considered legit then Father Harvey might have abused of his victims one last time, by triggering the limitation clauses. I like to believe that the Diocese of Chicoutimi is acting to ensure that Father Harvey’s victims will be duly compensated; but the bigger picture is obviously that virtually all parish councils and dioceses now know that their own civil liability insurers will not stand by them in cases of clerical abuse cases. And that’s good news; because the Church will have to reduce it’s exposure to litigation; one way or another.

  13. bc says:

A class action involving the victims of Father Harvey now names the Bishop of Chicoutimi as a defendant. Nine parishes are being sued: Saint-Dominique, Sainte-Famille, Saint-Philippe de Jonquière, Sacré-Coeur de Jésus, Notre-Dame-de-la-Paix, Saint-Joseph, Saint-David, Saint-Gabriel-Lalemant de Ferland-et-Boilleau, Saint-Alphonse; as is their civil liability insurer L’Assurance mutuelle des Fabriques du Québec.

There are one hundred victims in this class action.
The parishe’s appeal of the decision to certify the class action was rejected last March 27th.
