The following information is drawn from Canadian Catholic Church Directories (CCCD) which I have on hand. media (M), the archdiocesan website (AW), and personal information (P)

19 October 2017:  after preliminary hearing has been committed to stand trial on charges related to sex abuse allegations of a 10th man (M)

July 2017:  Report in Acadie Nouvelle that two new lawsuits have been filed.  This now accounts for all three boys referenced below  who were taken by Father Arsenault on a trip to Massachusetts in 1972.  One of the plaintiffs also alleges sexual abuse by Father Camille Leger which began in 1967 when the boy was 10 and last for about two years.

19 June 2017:  Report in Acadie Nouvelle that a of new lawsuit has been filed.  I am unable to download the page and am unable to link to the google translate of the article.  Here is an external link to the French article

According to the google translate the allegations date to the 1970s when the plaintiff, now in his 60s, was 17-years old. The allegations are that the sexual abuse transpired when Father Arsenault took the plaintiff and two of the plaintiff’s friends on a trip to Massachusetts in 1972.   The plaintiff was at the time a parishioner at the Roman Catholic Church in Haute-Aboujagane, New Brunswick (that would be Sacred Heart).

18 May 2017:  In court facing new charge of indecent assault against a male.  The allegations date to the 1970s.

February 2017:  Sentenced to four years in jail

25 October 2016:   GUILTY plea

22 January 2015:  there are now 17 charges and 6 (?) complainants

March 2015:  three charges laid in Miramichi – the charges fall under sections 156 (indecent assault on a male) and 157 (gross indecency) of the Criminal Code.  I believe there are now a total of 20 charges and 7 or more complainants.

Lawsuit filed alleging Fathers Breau and Father Yvon Arsenault repeatedly sexually abused (sodomised) a young boy at St. Joseph’s RC Church in Shediac in the early 1980s.  The boy, who was 13-years-old when the abuse began, was at the time a young offender ordered to do yard work on the rectory and/or church grounds:  The two priests were said to be responsible for supervising the boy. The abuse spanned a two-year period in the 80s.  I have no record of Father Arsenault being at St. Joseph’s in the 80s.  Can anyone help me with this?  (I have been told that Scouduc is only about 8 kms from Shediac)

08 January 2015:  two new charges laid from two new complainants.  There are now 9 complainants.

December 2014:  four charges have been withdrawn.  There are now seven complainants

24 February 2014:  elected trial by judge and jury

December 2013:  charged with three counts of indecent assault and four counts of gross indecency.

The following is an unofficial translation of Jean-Marc Doiron’s article in the 30 December 2012 edition of Acadie Nouvelle.  The original French text is below.

DIEPPE – Two former priests, Yvon Arsenault and Irois Després, are alleged to have committed sexual assaults on minors. They have been removed from any ministry duties by Archbishop Valery Vienneau, this weekend.

Just as the dust settled on the scandal of father Camille Léger, in Cap-Pelé, the Archdiocese of Moncton is facing suspicion of paedophilia brought against two other priests.

This involves Yvon Arsenault, who has worked in Kent County and south-eastern NB from the mid-1970s until his retirement on July 4, 2012, and Irois Després, who worked in the same area from the early 1960s until 1992.

The press release does not indicate if criminal charges have been laid against two men, or the years in which these acts have been committed.

A letter from Archbishop Valery Vienneau was read in all churches of the Archdiocese of Moncton this weekend. It informed all parishioners of the two priests’ withdrawal from any clerical duty.
“I sincerely ask forgiveness from the victims and their families”, the letter states.

A conciliation process, similar to the case of Camille Léger, has been initiated by the Archdiocese to compensate victims. It will be overseen by the same individual, the former judge,  Michel Bastarache.

“We fully support the process initiated by Mr. Michel Bastarache for the victims and we will be vigilant so that anyone working in the Church fully respects the policies put in place to prevent such acts”, Archbishop Vienneau states in the letter.

The allegations against Yvon Arsenault and Irois Després arose during the reconciliation process for father Léger.

Together, the two former priests have worked in 15 parishes.

Yvon Arsenault has been the parish priest of Notre-Dame-de-Fatima, Collette, from 1976 to 1982, the parish of Saint-Jacques-le-Majeur, Scoudouc, from 1982 to 1983, the parish of Notre-Dame-de-Grâce de Moncton from 1983 to 1989, the pastoral unit “Étoile de la mer” in Baie-Sainte-Anne and Pointe-Sapin, from 1990 to 1994, the parish of Saint-Louis-de-Gonzague de Richibucto, from 1994 to 1997, the parish of Christ-Roi of Moncton, from 1997 to 1998, the parish of Sainte-Thérèse-de-l’Enfant-Jésus of Dieppe, from 1998 to 2000, the unit pastoral Sainte-Famille in Cocagne, Notre-Dame and Saint-Antoine, from 2000 to 2007, and St Augustine Parish of Moncton, from 2007 to 2012.

For his part, Irois Després served as priest in the parish Saint-Ignace-de-Loyola of Saint-Ignace, from 1960 to 1968, the parish of Notre-Dame-de-la-Merci of Pointe-du-Chêne, from 1971 to 1973, the parish Saint-Vincent of Sackville, from 1973 to 1979, the parish of Notre-Dame-de-Lourdes, from 1979 to 1983, and the parish of Sainte-Thérèse-de-l’Enfant-Jésus of Dieppe, from 1983 to 1987.

Unlike father Camille Leger, who was already deceased when the allegations (against him) were publicly revealed, Yvon Arsenault and Irois Després are both alive.

From Acadie Nouvelle – Jean-Marc Doiron, reporter:

Feed My Lambs continues with Fr. Yvon Arsenault (Father Yvon Arsenault Feed my Lambs)

Archdiocese of Moncton website
On Wednesday, March 10th the third session of Feed My Lambs
took place at St. Michael’s Church in Moncton with Fr. Yvon
Arsenault, priest moderator of Queen of All Saints. One of the most
life-giving aspects of priesthood for Fr. Yvon is preaching. Prior to
his ordination, an uncle asked that when he preached he use a
language that ordinary folks could understand, and Fr. Yvon said
that comment has stayed with him throughout his 42 years of
priesthood. He mentioned that Fr. Bill Burke’s comments during It’s All
About the Mystery concerning the recovery of the Word brought about
through Vatican II really resonated with him. Fr. Yvon sees the
priesthood as a call to be at service to the people of God and said that
this is the call he has responded to, and the one which is the most
important to him as a priest – being with people in their need, whatever
that may be. Feed My Lambs continues at Immaculate Conception
Church in Rexton on April 29th with Fr. Alfred Desautels, C.Ss.R.

  4. Mike Fitzgerald says:

These charges are obviously new ones – are there more victims, Baspuits? Mike.

  5. Mike Fitzgerald says:

Also curious, Baspuits – this creature is being referred to as “a former priest”. Has he been defrocked officially, or just “suspended from duty” and is still a Roman Catholic priest?
If he is still a Roman Catholic priest, he should be removed immediately. He sullies the priesthood – likewise his superiors. Mike.

    • Sylvia says:

He hasn’t been defrocked Mike. Unfortunately the media often refer to a priest who is retired or suspended as a “former” priest: it causes lots of confusion for all of us :(.

  6. Mike Fitzgerald says:

Thanks Sylvia – I feel that I must address this – He has been an ordained priest for almost 50 years! I am left wondering how many other victims have been left in his wake that are not speaking.
I also wonder how many times through those years he performed the Sacraments without going to confession himself?
Judging by the media pictures I see of Father Arsenault, it appears that the good Father thinks this whole matter is funny, and a bit of a joke.
Bishop, go ahead and give him his pension and benefits, but get him out of the priesthood! He does not belong there! Mike.

  7. Mike Fitzgerald says:

You know JoeB, there is a place here for forgiveness. I can understand only too well that we all make mistakes and do wrong things on occasion. I am one of those.
That having been said, only a complete idiot keeps doing the same thing over and over and over and over again, expecting a different result each time.
Father Yvon Arsenault has a long sordid history, with a flotsam wake behind him longer than Haley’s Comet.
If it wasn’t for this history, I might be inclined to offer forgiveness as I would expect myself.
This isn’t the case here. Mike.

    • JoeB says:

Mistakes are things like turning right on a red…. forgetting to carry the one when doing math… putting too much salt on your dinner. What these rapists are doing is premeditated and cannot be considered mistakes. There is no room at all for forgiveness on this subject in my opinion.

  8. Mike Fitzgerald says:

You’re right JoeB. I agree. I just hope he is completely removed from the priesthood, and is given the professional help he so desperately needs. His victims deserve no less!
As a matter of opinion, I believe his victims deserve much more help than he and his superiors should EVER get. We shall see……………… Mike.

    • JoeB says:

Removing him from the priesthood is only a start! Like all sexual abusers he should spend the rest of his natural life in prison. I said in a previous post that I have a family member who is a priest and is profiled on this site …. well that is my cousin Yvon ………. maybe he will spend the rest of his life in prison now with new charges.

  9. Baspuits says:

We waited and waited to see him, at 11:45am, came out in the prisoner’s box, not shaved and looked to say the least, more like a bum!
He had no lawyer, so back in court on the 22 of June 2017, at 9:30 to enter a plea!
Several victims were there and we (Donald Landry and I) found out that several victims have not yet come forward, to the police!
This ex-priest Yvon Arseneau is not finished from hearing from victims!
Hopefully at the end he will get his 10 years behind bars, which is the maximum of sentencing, at the time of his crimes committed!
My take is the court should strike out any plea bargaining for pedophiles and get the maximum of sentencing!

    Baspuits

  10. Sylvia says:

Thank you Baspuit! Bless your hearts for being there to support the complainants and keep tabs on what’s going on . As you know, it’s so important.

I pray that those who have not yet come forward will find the courage to do so, and commend those have already done so.

Agree with you 100% that there should be no plea bargaining for molesters!

    • Jean-Louis says:

      Hi Sylvia,

Since his sentencing in February, I have had at least four people (or members of their family) reach out to me and told me that they had yet to report anything to the police. I shared my story, my experience with both the civil and the criminal justice systems, and hope I was able to inform their decisions.

I join you in thanking Baspuit and Donald for being there for us, and in encouraging other victims to come forward. While Yvon Arsenault is alive and breathing, new charges can be brought against him – even if he is sitting in a federal penitentiary!

      Jean-Louis

  11. Sylvia says:

Right you are Jean-Louis – even in jail he can still be charged. Let’s hope and pray that those with whom you spoke who may have been molested by this man find the courage to go to police.

And, Joe, right you are. If victims keep coming forward perhaps he will spend the rest of his years in jail, begging God for forgiveness, begging his victims and their families for forgiveness, and down on his hands and knees praying for his many unfortunate victims.

  12. Former Shediac Cop Shot says:

I curious to know why everyone seems to think he’s the only one. It’s virtually impossible for such crimes to happen and not get revealed for so long unless someone else is abedding & abiding. I’m hoping the police net will extend to answer why and how these Shediac Unsolved/Solved crimes were allowed to exist and go on for so long and nothing was done to help & Protect the public?

    • JoeB says:

FSCS I don’t think ANY priest can get away with these crimes for as long as these animals have without enablers clearing the path for them. I also don’t think everyone believes they acted alone, except those who enabled them.

    • Jean-Louis says:

Your suggestion that Yvon Arsenault is a “fall guy” for anyone else is misleading and untrue. He isn’t taking the fall for anyone else but himself and his actions. He got away with it for all these years because we didn’t lodge formal complaints to police authorities. True, he had been recycled from parish to parish – he had already molested before arriving in my parish… However, will someone be criminally charged for that? I doubt it.

The press has alleged at least three other in the Moncton Archdiocese (including Camille Léger, Paul Brault, and Irois Després). Several priests have been convicted in the Bathurst diocese. Victims need to continue coming forward and filing complaints to the RCMP. Otherwise, molesters will continue dying off before facing justice.

  13. Former Shediac Cop Shot says:

Well I guess he’s the fall guy… that’s Justice the NB way…. at least one got fried, pardon the pun, so the show drags on…. protect your kids folks no one else it seems will.

  14. Sylvia says:

There is a report in the 19 June 2017 edition of Acadie Nouvelle that a of new lawsuit has been filed against Father Yvon Arsenault and the Archdiocese of Moncton.

    • BC says:

      Hi Sylvia,
The Acadie nouvelle story actually says that the plaintiff and two of his friends were assaulted in 1972 during a trip to Massachussets.

Wonder who’s picking up his tab ??? Good question from reporters to ask archbishop Valery Vienneau: When do you stop paying for these criminals???
Or will Yvon Arseneau sell off his stamp collection to pay his bill???…….
Will he get added years if found guilty??
So many questions with few answers

We knew Yvon Arseneault very well when he was our pastor in Richibucto, N.B. He was there for us when we went through a family crisis. We are shocked and very saddened by what has happened.

What is a pedophile better at then abusing little children? Is making you believe he wouldn’t, in a priest uniform, never……….
Sad but true, for far to long…..

        Baspuits

  16. Sylvia says:

Thank you so much Baspuit. The date has been added to the page and the legal calendar.

I checked back through the Father Picot articles and found a January 2015 reference to “Dave Paulin” as his lawyer. Does that sound like the right name?

I wonder why he changed lawyers?

And, yes, like you I wonder who is picking up the tab? Is he on his own for this, or is the diocese pitching in?

  17. Top Down Corrupt System says:

It’s an all around sad case when a minister who suppose to show people the Love of God winds up serving the devil, as the thief, refered to in John 10:10, instead of his calling or oath, through his flesh. But what else is knew everyone else does.

This priest was, as Jesus said in John 10:10, in NB it seems he was stealing, killing and destroying not giving life or abundant life….

People need to open their eyes that when you trust leaders unconditionally and not put in place boundaries of accountability because of the position they have is absolutely crazy to think they will act in anyone’s best interest when people are by nature selfish…. or to trust an organization of anything to act in the right way when one of their members is caught.

  18. Baspuits says:

On the News tonight ex father Yvon Arseneault will have to answer to charges of 2 more victims have come forward.
So next Thursday on the 3rd we will see his lawyer asking for a new date to answer these new charges……..
Welcome to the slow wheel of New Brunswick justice system…….

    Baspuits

    • Sylvia says:

🙂 Yes, Baspuits, it’s two more lawsuits for sure. Perhaps two more victims as well?

I just posted the article: 27 July 2017: 2 new lawsuits filed against ex-priest and Moncton archbishop

That’s now 12 lawsuits involving Father Arsenault before the courts. How many other victims ‘settled’ out of court through the Bastarache ‘conciliation’ deal? Does anyone have any idea? In other words, do we have any idea at all how many victims of Father Arsenault have come forward to date?

Interesting too to see that one of the plaintiffs/victims in one of the lawsuits also alleges sex abuse by Father Camille Leger. Remember five years ago when members of the Knights of Columbus and parishioners at St. Theresa in Cap-Pele, New Brunswick asked for a name change for the Pere-Camille-Leger arena because, they alleged, Father Leger had molested multiple children in the community between 1952 and 1980? That’s when the lid started to blow off the garbage can. On one hand it seems an eternity ago, on the other hand it seems like yesterday. Hats off to those who fought to get the name of the arena changed, and hats off to every victim since then who has fund the courage to speak up and identify thier clerical molester by name, and, where possible(if he’s alive), to see charges laid against him.

Thanks Baspuits. So glad you were there.

I just posted an article from CBC: 03 August 2017: Disgraced priest Yvon Arsenault will plead not guilty to new sex charge

  23. Discusted & Betrayed says:

After carefully reading some of these messages I’m now wondering if all the priest from the 70’s onward were child molesters?

  24. Mike Fitzgerald says:

Disgusted and Betrayed – it really doesn’t look good on the church, does it? The fact of the matter is that most Roman Catholic priests are still the “good guys” – I would think that the vast majority of ordained catholic priests are still good, holy men who are actually dedicated to their calling.
The problem is this – when we hear about a wayward and disordered priest, their superiors (bishop, cardinal, pope, whatever) tend to try to hide the facts from the general public, ostensibly to “prevent a scandal”!
What these church administrators still don’t get is the fact that you can’t hide a scandal that already exists! Misleading the “flock”, and desperately trying to deflect responsibility for these deviants to others makes the “scandal” worse.
Even worse, the victims of these deviant priests are marginalized, and re-victimized by the church, in an twisted effort to maintain “the good reputation” of the church.
They still don’t get it! Mike.

  25. The Victim's Voice says:

Interested points of view in here but when one priest does something so dark as to molest a child, never mind multiples for 30 years, and the so called “Church” hides it or better still transfers the problems to other communities, sort of speaking, hitting the reset switch and turning back on the Priestly hallo if causes me to think when all the other priest surrounding this criminal issue said and did absolutely nothing to prevent & stop it, that the problem is bigger that you all would like to admit in here.

It’s no longer a Priestly ministry but a good old boys club protecting their evil ways and image at the cost of others and they have betrayed God, the people and their oath by doing so.

The deterrent is to low if it was higher they would leave the Offices before the righteous would drive them out… if there’s really are some left.

When you leave messes like this to the victims to clean up you can’t really say the church/System is protecting people by doing the work of God in this regard.

  27. Mike Fitzgerald says:

The Victim’s Voice – interesting that you note the silence of fellow priests, in the face of one of their own coming up on criminal charges.
Obedience to the bishop is a vow priests take upon ordination. To cross a bishop with disobedience has temporal consequences, which most priests do not want to invite. Hence, I believe, a fear of repercussions should they speak up.
It all comes from the top, and filters down through the ranks. If the priests are told to shut up, they shut up. Mike.

  28. Shediac Priest Charged says:

Just a thought here, but is there anyway that this former Priest of the Roman Catholic Church could ever repent and be really sorry for what he’s done to children and be forgiven by his victims and restored so he can help those involved in such dispicable sexual crimes by exposing how it’s done and handled behind closed doors?

    • Jean-Louis says:

      No, no, NO!

At 74 years old, with 30 years of denial, and over 3 years of pleading not guilty, with a plea bargain at the 11th hour AND starting the entire process again now, I believe this CONVICTED CHILD MOLESTER is not a person who could be a ressource person that could EVER be restored so he could “help others”…

“Exposing how it’s done”? What does that mean, exactly???

I would NEVER trust this MOLESTER behind closed doors again – are you kidding??? He will be on the Canadian convicted sex offender list for the next 20 years! I’m not sure what kind of “community help services” you’re thinking about – but I doubt it would work in most people’s realities…

      Jean-Louis
victim of aforementioned “former Priest” who has no intention of ever allowing this person to EVER have access to any official helping capacity in society – EVER!

PS – Sociopaths are unable to “repent and be really sorry”… It is part of what makes them sociopaths…

  29. Mike Fitzgerald says:

Shediac Priest Charged – Father Yvon Arsenault is still a priest! He is NOT a “former” priest as you allude to.
This is the essence of the problem here – he is still an ordained priest in the Roman Catholic Church, with all the powers that go along with his title. Just because his bishop says he is retired and is not allowed to perform public ministry does NOT mean he is no longer a priest. Mike.

    • Jean-Louis says:

I agree with you, Mike, that as POLICY, any priest convicted of sexual molestation (or any other sex crime) – whether still serving or retired – should AUTOMATICALLY be defrocked!

This seems like a no-brainer… Oh wait! Denouncing practicing pedophiles within your organization ALSO seems like a no-brainer – yet it’s not happening AS POLICY…

      Perhaps some day…

      Jean-Louis

  30. Mike Fitzgerald says:

JL – suffice it to say, Bishop Vienneau has a lot to answer for. Why this vermin remains a Roman Catholic priest is beyond me, and many others. Mike.

  31. Shediac Priest Charged says:

He might be able to function as the Prison Champlain since he still remains a Priest.

Case of ex-priest Yvon Arsenault on 8 sex charges adjournedYvon Arsenault, accused of abusing 4 boys, to return to court on Dec. 9 for preliminary inquiry

    September 02, 2014

The case of a former New Brunswick Roman Catholic priest, who is facing eight sex abuse charges involving boys dating back to the 1970s, has been adjourned for three months.

Yvon Arsenault, who was suspended by the Archdioces of Moncton in July 2012, is scheduled to have a preliminary inquiry on Dec. 9. (CBC)

Yvon Arsenault, 71, of Aldouane, was scheduled to have a preliminary inquiry in Moncton court on Tuesday.

But the matter was set over until Dec. 9 at the request of his defence lawyer, who wanted all of the alleged victims to be present.

Arsenault did not appear in court.

He is charged with three counts of indecent assault, four counts of gross indecency and one count of sexual assault involving four boys under the age of 18.

The incidents are alleged to have occurred in Shediac, Rosaireville and Collette, N.B., in the 1970s and early 1980s.

The RCMP started an investigation in December 2012 as a result of a complaint.

Arsenault was removed from his position by the Archdiocese in Moncton in July 2012 and retired the same month.

He was charged in December 2013 and elected earlier this year to be tried by judge and jury.

The preliminary inquiry will determine if there’s enough evidence to proceed to a trial.

Why are you reprinting an article that is three years old? Yvon has been convicted of child molestation last year!

Also, convicts don’t get to act as “prison chaplains”… Sort of like the blind leading the blind…

You seem awfully interested in Yvon “helping” others. What gives???

That would go over “Big Time” with the other inmates!

  33. Shediac Priest Charged says:

Well they tell me that with God all things are Possible. So Maybe they can help each other.

There got to be a way to get out of this something positive.

    • Jean-Louis says:

Why are you so excited about getting “something positive” out of this? Do you honestly believe that a bunch of pedophiles can “help each other out” while serving time in a federal penitentiary? Do you believe that they can help each other get rid of their sick little urges to touch children?

Please read my answer to you on August 17th. You never did acknowledge me with an answer.

When these pedophile priests were molesting the children, there was no god present.

  34. Shediac Priest Charged says:

Sorry never saw your posting of Aug 17 so Joe and Jean-Louis must be the same guy, interesting.

What’s the difference between a Drug Dealer and a Pedophile when it comes to children. It’s not what a person gets that matter in these cases but if their actions spoil others and in bitterness, hatred and revenge they don’t in turn hurt others.

    • Sylvia says:

FYI SPC, Joe and Jean-Louis are NOT the same person.

    • Jean-Louis says:

      Dear “Shediac Priest Charged”,

I do not use a pseudonym on this site (and in the media) ever since I went public as one of Yvon Arsenault’s molestation victims. I hope this clears up any confusion that I may be “talking to myself” on Sylvia’s site as “Joe” and “Jean-Louis”.

As to YOUR persistent hypothesis that Yvon (a convicted sex offender presently serving time in a federal institution) could help other sex offenders while incarcerated, I strongly believe that decision should be left to professionals who work in the correctional and rehabilitation systems. I will therefore not debate the values of treatment programs for either sex offenders or for drug abusers here.

I just wonder… Who are YOU, “Shediac Priest Charged”… One of Yvon’s friends? Supporters? Just a super-religious idealist who has to find a positive spin on life’s every tragedy?

The common factor is that children are the targets and in both examoles it damages their lives.

I was just wondering now that “the roman catholic priest” has a lawyer if he’s going to remand the cases till it’s all thrown out of court?

For your information I was molested by a guy from Riverside Drive when I was 5 years old. It changes your life that for sure but you don’t need to camp there. Nothing that happens to those guys will restore or help you only forgiveness will do it.

Unforgiveness is like drinking poison and expecting the other one that wronged you to die but it’s killing you instead. Get on with your life by helping others.

We will find out if it goes to trial in December, and think I over heard that the criminal will change from judge and jury to judge alone! The trial would be in the next year!
Donald Landry and I, plus several victims (that can’t be named of other priest) shaid several tears of what we heard, brought us all back to when we each were 11 years old………..some of us weren’t prepared to what was going On!
All of these tacktic is to positioning himself in plea bargaining, in not getting more time in jail. This should NOT happen!!!
Let’s put it this way, if the pedophile Levi Noel got 8 years, for what he did to us, which was a raccord at the time , this ass hole Yvon Arseneault should get DOUBLE and a not measly 4 years…………or time served!!!
Afterward we, outside the courtroom we huged all the victims, and let them know “THAT THE SHAME DOESE’NT BELONG TO YOU”!!!

That’s all for know, got to get me a stiff drink!

We now know that the hearing is over, and that – by the sound of it? – the judge will release his/her decision as to whether or not he/she believes there is sufficient evidence to go to trial.

  40. Sylvia says:

Father Arsenault has been committed to stand trial:

19 October 2017: Convicted Moncton priest could face trial on new sex charge next year.

The trial date has yet to be set.

Please keep the complainant in your prayers.

(I must add here how encouraging it is to see Baspuits and other victims attend court regularly in New Brunswick to offer their support. I am sure your presence was and always is greatly appreciated. It is so important for complainants to know that they are not alone.)

  41. Baspuits says:

Just got a call from victim aid, that the pedophile Yvon Arsenault court date is on the 20 to the 24 of August 2018!!!
I was assured that he can not apply for early release until these charges are heard, one way or the other!
Poor victims another set back………..has to wait to be heard, again!

    Baspuits

    • Jean-Louis says:

      Thanks, Baspuits!

One consolation for the victims is that this convicted molester is ACTUALLY in prison, serving time! Hopefully, this will make it somewhat easier for the victims to wait until August. The delay tactics often used by the defence can be much more irritating when the accused is out, going on with his business!

      Jean-Louis

  42. Sylvia says:

Thanks Baspuit. I have posted the info and added it to the Legal Calendar.

I tried to call to confirm but got an answering machine. Will try again.

I wonder of he could out in a half-way house before next August? That wouldn’t surprise me. I hope all victims have asked that they be notified of any hearings held regarding requests for early release. I think they should also have a right to be notified if and when he is granted such things as day parole and/or relocation to a half-way house?

  43. Sylvia says:

Good for you Jean-Louis. Keep us abreast of any news in that regard.

    • BC says:

97% of torts are never litigated and/or ADR’d. Almost all of that 3% are ADR’d. 56 court cases does translate indeed into hundreds of primary victims and thousands of secondary victims. The sum social costs of clerical abuse in New-Brunswick is approximately 400 million cda. Actuaries can do the math much more precisely. Liability insurance coverage for the Church in N-B will soon become a luxury that the faithful in N-B won`t be able to afford. Without it the Church cannot lawfully operate. Nobody in their right mind is gonna want to do business with Bishops in N-B and when they do they`re gonna want to be paid upfront now that it`s proclaimed that it`s running out of cash.

This is happening as the Pope is advertising for Lamborghini in Rome. This is not Christ who couldn`t even afford a decent ride to Jerusalem. This is a public relations stunt, Pope Francis, not giving away a Lambo for charity; but advertising for Lamborghini on the world’s stage. I really wouldn`t be shocked if Pope Francis canonized the Chairman of Goldman Sacks next year.

What is the social good being served by the Church in N-B and it’s assorted charities?

    • Baspuits says:

Why so many law suit in the diocese of Moncton, compared with (at least 3 left) from the diocese of Bathurst??
Could it be that the Bathurst victims were offerd a 500$ to consult or have a lawyer present when given their story, and another 500$ to/for a lawyer of his or her choice, so as to explains what one signs on the dotted line! Some victims went with another victim, some had their wife attend, in meeting Bastarache!s team!
A victims of the diocese’s of Moncton sat alone in front of a table with how many lawyers representing the diocese, and tell their horrible abuses and life style they had to indure!!
Anything said at these meeting can not be verified or contested!!!

That!s why I think so many lawsuits for the dioceses of Moncton compared to the diocese of Bathurst in a nut shell!!!

07 December 2017: Priest accused of sexual assault won’t have to go through trial

I know absolutely nothing about Father Breau’s mental health of competence. I do know that he was still serving as Chaplain at University of Moncton NB until some time last year, and that in October 2016 was serving as Chaplain during the week at the Motherhouse of the Sisters of Our Lady of the Sacred Heart in Moncton.

Does anyone know if these charges related to the repeated and long-term sodomisation of a 13-year-old boy at St. Joseph’s in Shediac in the early 80s?

Hope he doesn’t play with the judge patient, as before….

Time serve will not help him, addional time in prison, would be justice served!!!

    • Jean-Louis says:

      Baspuits,

1/6th is 8 months – this came and went in October 2017 He’s heading for his 1/3rd… He was sentenced on 24 Feb 2017, so 16 months would be 24 June 2018. If he gets out then, he will still have to report to a parole officer, be limited in his travels, etc. until the end of his sentence (Feb 2021). And, of course, there is the upcoming criminal trial in August.

There is never enough time in prison for him… Even if he served the entire four years, it’s not enough… Would 10 years be enough? No…

I am comforted to know that he did, in fact, sleep in jail, and society has learned that Yvon Arsenault is a CONVICTED SEX OFFENDER… That will have to be enough for me to move on…

      Jean-Louis

  51. Baspuits says:

Yes, just posted the following articles with the latest on the Monsignor Capella scandal:

08 April 2018: “Vatican arrests ex-diplomat in child sex abuse probe” & related articles

I am wondering if, now that this is being handled in the Vatican by a Vatican court, we in Canada will ever find out which church he was visiting in Windsor Ontario, and why?

  54. Accountable says:

Catholic priests take a vow of celibacy when they’re ordained. But when they break that vow, their children are left to live a lie

Canadian children of priests have struggled with guilt and suffered from being forsaken by their fathers. Pressure is mounting for the church to hold priests accountable as parents.

  55. Baspuits says:

I sent out to all reporters, some 15 via messenger, of up coming trial of Yvon the terrible Arsenault on the 20th to the 24th, if he continues pleading not guilty!
One came back, after I told her who is lawyer was, she said afterward:
Ça commence le mardi 21 aout. Salle de cour 12 au 3 étage.
It’s starts Tuesday 21 August. Court room 12 on 3rd floor.

Just in case some of you show up on the 20, and see nothing!

I have sneakee suspicion, plea bargain is in play, for pedophiles should never happen!
Please, we can’t change the church, but we can chance the LAWS!
No to plea bargain for pedophiles, to come clean!

    Baspuits

    • Jean-Louis says:

Thanks for the information, Baspuits. I’ll be watching CBC, Moncton Times, and Acadie Nouvelle (and, of course, Sylvia’s Site!) for any news on Yvon’s upcoming trial and possible plea bargain… whether or not he chooses to do the same thing at the 11th hour as he did in our case in 2016…

As it stands, Arsenault is still incarcerated, serving his four year sentence that started on 24 Feb 2017. I have heard from a very reliable source that he is not looking well at all, finding prison life difficult, and is not wearing a smug smile like he did on the cover of the Times in 2016! This information gave me some comfort!

Unfortunately, plea bargains cannot be “crime specific”… imagine that murderers and rapists can plea bargain… all crime victims would agree that their injustice is the worse – the law is designed to have no feelings – “innocent until proven guilty for all” – even for Arsenault.

Let’s hope that, if he pleads guilty or is found guilty, that his sentence will not just be added to the sentence he is already serving!

  56. bc says:

In R. v. Anthony‑Cook, [2016] 2 SCR 204, 2016 SCC 43 the Supreme Court of Canada described plea bargains as “vitally important to the well-being of our criminal justice system,” without which the justice system would “eventually collapse under its own weight.” It’s not just one opinion on the matter. It’s a judgment of the SCC and it is by it’s very legal essence, the law. You can’t appeal a judgment of the Supreme Court of Canada. I understand your sentiment about joint-submissions and plea bargains. But one cannot just conveniently ignore that the illness that you have diagnosed cannot be cured by a legal remedy in Canada.

  57. Baspuits says:

What’s you thinking on the seal of confession, for which the church has brought back the “individual confession” some 4 years ago?
If a child confess that he is being abused by, let’s say the vicar, will priest confessing the child call the authorities as the law state here in New Brunswick?
Or are we the same as the state of Louisiana, where the seal of confession trumps the state laws, on child protection???
Isn’t the confessional box for telling ones sin and receiving penance? A child being abused is this a sin toward himself ?

It’s about time we do, as one priest told me ” you will have to cut me in small pieces, before I tell you, of what I heard in the confessional box”!
Drastic measure is needed in drastic time!

We are talking about the safety of childhood………
As I said before the church doesn’t want to change, so let’s change for stricter laws!!!

    Baspuits

    • bc says:

I think that the issue isn’t the seal of confession per se. The issue is compelling witnesses to testify. If we`re going to compel priest to testify about what they witnessed during confessions; should we not also compel victims of clerical abuse who refuse to lay charges and/or testify; because their testimonies could also lead to convictions of clerical criminals? It`s a slippery slope. If we compel priests to testify their testimony will be in effect coerced and the very credibility of their testimony will be in question. I don’t like the idea of secrecy of confessions within the context of the cover-up of clerical abuse. But I oppose compelling witnesses who happen to be victims of clerical abuse.

      • Baspuits says:

        Compel a 10 year old child”…………..to WHAT?
        I’m talking about notifying authorities…….
If priest can groom a child, to abuse him or her, he can groom a child to find out who’s abusing him or her. Then call the authorities!
Confessional box, history will tell us, is the most evil tool ever invented, in taking advantage of small children. Period!

If holding the bag is as guilty as putting in the bag. We’ve been led by the biggest pedophiles ring, since Adam & Eve!
        Baspuits

  58. Baspuits says:

    Sorry to say:
If you stand by the catholic church, if you donate time and money to this organization, you are complicit. There is no way around it. This will not be the last report. It will not be the worst report. It’s just the latest in a long line. And we all know this to be true. If you still support the Catholic Church, you are complicit in the rape of children and its coverup. If you think that is too harsh, start thinking about the victims instead!

    Baspuits

    • bc says:

There is no guilt by association, and there should be no guilt by association in Canada. If such a concept was enforced you could be convicted for being an accomplice of Arsenault because both of you are residents of New-Brunswick.
According to your own logic; by paying your taxes in New-Brunswick you enabled Arseneault because he was using public services in part paid by yourself while he was committing his crimes.

Freedom of religion is a fundamental human right in Canada. Your argument; that a quasi-constitutional right can itself be held against a person- is legally unsound.

      • Baspuits says:

        Hog wash!
Paying my taxes, enables pedophiles priest in abusing small children………hog wash!
I can change my vote every 4 years, and there is a penalty in not paying ones taxes!
Compare to what, giving freely, money to the church and they protect pedophiles priest?
In my case I’ve met 9 lawyers who were hired to defend Levi Noel, money used was not from the vatican, I assure you!

  59. Prima Facie. James Porter Bateman says:

Baspuits; of course under “BC’s” argument, it is legally unsound, but, Baspuits, I agree with your opinion. However, under “BC’s” argument, which after reading his hundreds of posts over the many months; (he appears to be “all knowing”), I would be “complicit” in many things. “Guilt by association”.

  60. 1Yellowknife says:

BC has articulate, thoughtful and interesting feedback. He/She may be a(n) (annoying) know-it-all and a prolific responder but too much is at stake at this critical time to make that a central issue of debate. Keep discussion focussed on the pedopriests and those who enabled them. Sylvia’s site is being closely monitored by many. The importance of her work is increasingly recognized and validated. Stay on task. Don’t detract.

  61. prima facie James Porter Bateman says:

Articulate away…wonderful, wonderful. Does this help, frustrate, defuse, de focus, control, intimidate, etc a “target group”, ie) victims, supporters, survivors, “the accused-their supporters”, family members, those who speak out, whistleblowers, etc. However, I am not a “pseudonym”. I may not be convincing with the written word. I am not writing to impress a publishing company nor am I auditioning for the role as “Chief Know It All”. However, during my time residing and working in Cornwall, Ontario, Canada, during, before and after the spectacle entitled, “Project Truth”, followed up by the costly and ultimately useless, “Cornwall Public Inquiry”, I knew and met many “friends by association”, of some of the accused. Many people came to me, some seemingly pleading for forgiveness, as if I could provide the forgiveness they needed. I was not even a victim of “direct” physical abuse; but believe me, as many other PEOPLE with real names who were/are friends, family members, supporters of victims and survivors, WE experienced abuse, we were emotionally, psychologically, financially, abused and many have been blacklisted. Some people asked for forgiveness from me and help, “what do I do” asked one prominent citizen. “We suspected…we knew what was going on, but we didn’t know what to do”, said another prominent professional. The list went on. My response was that they should step forward and present their information publicly or through Justice. However, “they” did nothing, the rapes continued, the abuse continued, the intimidation continued. “They” remained active in their Parish and with their Church. In those years, because of what I experienced, I was not even shocked by their disclosures, not even by by their “prominent citizen” status or the various professions they were “associated” with. Many of these people (“Associations”) thought that by talking to me, at the request of my own personal Clergy, would somehow exonerate them or absolve them of any guilt.
If you have built up to watch the film “Spotlight”, you know what I am writing about. If you haven’t, then watch it. Similarities to Cornwall are striking, to say the least. Similarities to the method of operation of abuse, cover-up, etc are exact. There may not be a legal term defining “Guilty By Association”, but there are legal, criminal offences encompassing the understanding of “Guilty By Association”.
I hope this writing is articulate enough for the people I am interested in reading it, can. THE END. James Porter Bateman

  62. prima facie says:

Articulate away, wonderful, wonderful. Does it help to defuse, educate, mitigate, defocus, control, intimidate, a “specific” target group; i.e.) readers, victims, supporters, family members, whistleblowers, etc. Or perhaps influence opinion on behalf of some other individuals or groups? But, I am not a “pseudonym”. I may not be convincing with the pen or type. I am not writing to impress a publishing company nor am I auditioning for the role of “Man of all knowledge and wisdom”. However, I resided and worked in Cornwall, Ontario, Canada, during, before and after, the spectacle known as “Project Truth” and the equally costly/questionable “Cornwall Public Inquiry”. During those years I knew and met many, many people-laymen and professionals, with knowledge that they elected not to disclose. Several people met with me over these years; people I would classify as “Guilty By Association”. Some of these people requested to meet with me, seemingly pleading for forgiveness, as if I could provide the forgiveness they needed. I was not even a victim of direct, physical sexual abuse or exploitation. But, believe me, like many other PEOPLE with real names who were/are friends, supporters, family members of victims and survivors, we suffered and paid a price; emotionally, psychologically, professionally, financially and in relationships. Others are blacklisted. The “Guilty By Association” people, some prominent professionals, some laymen, asked for forgiveness and wanted help from me. They stressed, “what would you have done James”? Some of “The Guilty By Association” stated, “we suspected and knew what was going on, but we didn’t know how to stop it”. The list went on. My reply was always. Speak out publicly and present your information to Justice. Some people said they did report but no one ever got back to them to follow-up. However, in time, these “Guilty By Association personalities did nothing and remained active in their Parish, with their Church. In those years, because of what I had experienced, I was never shocked by these disclosures by those, “Guilty By Association”. I was never shocked by their prominent citizen status or professional status. For some reason, some of these prominent citizens believed that because my Clergy asked me to speak with them at their request, they would be forgiven, exonerated from any guilt, relating to abandoning children who were being raped, sexually abused, assaulted, groomed, threatened, intimidated, etc. etc.
If you have built up the courage to watch the film “Spotlight”, watch it again. If you haven’t watched it, then watch it. There are striking similarities to Cornwall and other areas where the same has occurred. The modus operandi, involves all the same parts, including protection of the accused, cover-up, intimidation. There may not be a legal definition for “Guilty By Association”, but there are well defined legal, criminal offences available, to provide the assertion of “Guilty By Association”.
I hope this writing is “articulate” enough so the people I wish to read it, can.
I have not returned to Church. THE END. James Porter Bateman

Don’t be surprised at what happen’s in the Justice System… because there’s none… the laws seldom effect the lives of the upper class as they are written by them to control the bottom class. Once in a while you’ll see some thrown under the bus to keep things in perspective but usually it’s due to an up rise to keep people thinking there’s some form of justice for the lower class when in reality there’s not.

The criminal stats in a Province/Country is effected upwards or downwards by convictions… I don’t think deals count.

    In the oceans you have;
    1- Sharks
    2- Salmons
    3- Bottom feeders

    In life you have;
    The upper class (takes 80%)
The middle class (lives very comfortably)
The bottom class (becomes the victims of society)
