Archdiocese of Moncton sues the Co-operators to cover abuse claims

The Roman Catholic Archdiocese of Moncton is suing the Co-operators for $4.2 million, and seeks a quicker summary judgement instead of a trial. The insurer disagrees.

The archdiocese, which had a policy with Co-operators between 1977 and 2000, is looking to recoup some of the $10.6 million it paid out to abuse victims through a confidential compensation process.

The lawsuit is complicated by the fact that neither the insurer not the archdiocese can locate the policy records. Lawyers for the archdiocese say policy limits were $500,000 per occurrence of abuse between 1977 and 1992, after which it increased to $2 million per incident.

“Co-operators can’t confirm what the wording is for the entire policy period,” the insurer’s lawyer told the judge.
