Court news for tomorrow and Friday….

Thursday, 22 January 2015

(1) Father Omer Desjardines OMI (Oblate priest)

Oblate priest Father Omer Desjardins will be sentenced tomorrow in Saskatoon:

22 January 2015: sentencing,  Saskatoon Provincial Court (220 19th Street East, Saskatoon, Sask)

Unfortunately I don’t have the start time.  His sentencing hearing started at 2 pm in the afternoon so it really could be any time of the day.  If anyone can pass on the start time please send me an email or post a comment.

This one has really flown under the radar.  Only one media article that I know of, and that from the sentencing hearing.  It has also moved very quickly.  Charges were laid September 2014.

Please keep the victim in your prayers.  And please pass along news of the sentence once it has been passed (or link to media coverage)

(2)  Father Yvon Arsenault (Archdiocese of Moncton, New Brunswick)

Father Yvon Arsenault is already facing 18 charges related to allegations of six  complainants.  Tomorrow he is back in court to answer to two new charges.

22 January 2015:  11 am, election on two new charges,  Moncton Courthouse, Moncton NB (45 Assumption Blvd)

I imagine these charges will be merged with the others?   and perhaps then the preliminary hearing will finally get off the ground?

I wonder what happened to his lawyer Gilles Lemieux’ demand for the Bastarche files?  Have they been disclosed?  or is that being argued out behind closed doors?

As always I urge those who are free to do so to get to the courthouse.  And, as always, please keep the complainants in your prayers, and please pass along news of the outcome.

(3)  Eric Dejaeger

Oblate member, convicted molester and ex-priest Eric Dejeadeger is back in court tomorrow for the continuation of his sentencing hearing.

22 January 2015:  09:30 am, sentencing hearing, Nunauvut courthouse, Iqaluit, Nunavut

Dejaeger’s lawyer is to wrap up his submission, At the request of  Judge Kilpatrick, Mr. Kempt is supposed to give a  line by line assessment of the Crown’s recommendations for each of the 32 charges.  The Crown has asked for 25 years less 2:1 for the time spent in jail (4 years) = 17 years.  Kempt objects.  He is asking for 12 years less 2:1 for time spent = four years.

Four years of course would see Dejaeger out and about in pretty short order on ‘good behaviour. ‘

So, we shall see.

Anyway, after Kempt finishes the Crown has opportunity for rebuttal.

And, tomorrow, ……

Well, tomorrow Eric Dejager will address the court!

The Crown has made note of Dejaeger’s lack of remorse.  Will this be apologies ++ ?  to woo the judge?

After seeing the stone-faced Dejaeger in court in person I can not conceive tears or anything close.  He never flinched when those poor souls were being torn apart while testifying, and in the process reliving what he had done to them.  Not a flinch.

We shall see.

And, whether or not Judge Kilpartick will pronounce sentence at the end of the hearings or opt to reserve his decision for another date remains to be seen.  It could go either way.  If he decides to reserve his decision there will have to be a date picked which marries up with the calendar of the court, the judge, Crowns and defence lawyers.

A final note here:  Two more articles have been posted:

(1)  Father Albert Laisnez (Archdiocese of Edmonton, Alberta)

Father Laissnez has been committed to stand trial in Alberta Court of Queen’s Bench.  Tomorrow is his first courtdate in Court of Queen’s Bench.

23 January 2015: for arraignment” in  (Edmonton? ) Alberta Court of Queen’s Bench

I will try to get the start time.

(2)  Eric Dejaeger omi

Eroc Dejeager has a courtdate in Edmonton on Friday morning.  This is related to his Edmonton charges.

23 January 2015:  09:00 am,  Edmonton, Alberta courthouse

I really don’t think he’ll be there!  But….???

Keep the complainants in Alberta in your prayers.  These charges were laid December 2011.  They have been left waiting, and waiting and waiting while the Nunavut charges snaked their way through the system.   I do pray that will soon have their day in court.

The picture of Deacon/Justice Terence Platana has been added to theinquiry.ca.  Oh my, if ONLY people had known that the judge on the bench of the ‘second” Leduc trial was a Deacon in the Church.  Cornwall connections plus a deacon.  Under the circumstances, totally inappropriate.

And Marie Henein defending Leduc.

I still get chills thinking back on the goings on at that “trial.”   It was wicked.  Totally wicked.  Perry didn’t stand a chance.  Not a chance.  I swear to goodness they were all after him:  the judge, the Crown and Henein.  A slaughter.  What Leduc did or did not do to those poor young lads was irrelevant. Perry was the bad guy.

Anyway, I started rounding up relevant files  – have posted a few and will continue to add.

I received a picture of Father Danny Mills (Yarmouth, Nova Scotia) this evening!  Most unexpected.  I will post it tomorrow.

Enough for now,

Sylvia

In my haste to get everything posted I have failed to mention the great coverage we are getting from the courthouse in Iqaluit – way up there in the frozen North. You made mention northern fancy. So true. CBC and Nunatsiaq Online – great coverage from everyone. Between the two, excellent! Live blogging from Peter Worden to boot. Love it. It’s a close to being there for all those of us who would so dearly love to be there and can’t.

  2. just another victim says:

CBC has posted that Omer Desjardins has received a six month jail sentence.

I am having trouble getting the link to copy. Here is the article.

An 82-year-old Catholic priest who pleaded guilty to a 1978 sexual assault north of Saskatoon is going to jail.

Father Omer Desjardins assaulted his young victim when he served in the town of Marcelin.

Judge Byron Wright sentenced Desjardins to six months in jail, to be followed by one year of probation. He also submitted his name to the national sex offender registry.

‘The sentence must reflect society’s revulsion.’
    – Judge Byron Wright
Wright rejected a defense request for a sentence to be served in the community.

“In cases involving the abuse of children,” he said.

“The sentence must reflect society’s revulsion.”

Desjardins was in Marcelin in the late 1970s.

He moved to Winnipeg in 1986.

After hearing the sentence, Desjardins quietly emptied his pockets and handed over his cell phone to supporters before deputies escorted him out of court.

His lawyer said he’s considering appealing the sentence.
