The following is a statement provided to Cornwall Standard Freeholder by a Cornwall sex abuse victim.  The names of his two molesters were deemed young offenders at the time of the abuse and therefore their names are under publication ban, as a consequence the victims’s name is under publication ban..   

This victim’s second offender was convicted and sentenced last week.  At the time the victim declined to give a comment to a Freeholder reporter.  He asked for time to think.  Amongst other things, he was concerned about the publication ban.  He hoped to be able to make a statement to the press after he had had some time. On 18 October 2008 "Probation for sex assault" ran in the Freeholder.   

The following statement was hand-delivered to the office of the Cornwall Standard Freeholder on Monday 20 October 2008. It is reproduced verbatim.  As you can see, the concerns of the victim regarding his molester's status as a high risk to re-offend and previous convictions were not addressed in the article of 18 October, nor do they appear in today's paper.  The victim is anxious to get this infomation out to the public. 


  I truly consider myself as being blessed.  As a survivor of historical sexual abused victim in the City of Cornwall, for forty one years I was labeled as an Alleged Victim and my perpetrators were labeled as an Alleged Pedophiles both being found guilty in a court of law.  I am no longer considered an Alleged Victim, I am a victim, and my perpetrators are no longer considered an Alleged Pedophiles they are a Pedophile.  

I was content and pleased with Judge McPhee’s ruling and sentencing of this Pedophile that victimized me forty-five years ago.  He has sent a clear message that these Pedophiles are not going to get away with these deviant acts.  And I understand that Judge McPhee can only sentence this perpetrator according to what the courts would allow.    

And he gave this perpetrator the max.  For both counts that he was charged with he received two years probation per count, but to be served concurrent.  He must hand over his DNA, to be put on file for Sex Offenders list.  He is prohibited from being around any children unless he is accompanied by an adult.  He was also ordered not to be around myself, my wife or my children.  He was warned by the Judge sternly that he would face jail time if he broke this ruling.  Also, he was ordered by the courts to continue his treatment through the Ottawa Royal Hospital. 

 During the previous court appearance September 17, 2008 his Lawyer was supposed to hand over his assessment from Ottawa Royal Hospital in which they did not abide.  Due to the fact that his Lawyer had stated it would cause some embarrassment on him and his wife’s sex life.  At that time the Judged ruled that the assessment be handed over to the Crown’s Office.  This assessment was completed in early 2008 around May.  The assessment had revealed that this perpetrator had served Provincial and Federal jail time for sexual deviant acts, including rape and sex with a minor.    

Most importantly he has been deemed as a High Risk Sex Offender.  The Judged has done the best he could do according to the law.  That I am pleased with.  The sad part is that this assessment had deemed this perpetrator as a High Risk Offender with a 39% chance of re-offending again.  If I would not have taken this perpetrator to court we would not have been able to obtain this knowledge.  He is in our community walking free without a bracelet with out a name or without a picture.  Actions speak louder than words.  We as a community need to work together in creating changes in order to promote healing as a whole community.  We as a community need to do something in regarding pedophiles walking free.  Legislation needs to be changed in order for us to provide a safe environment for our children of our community.
