Too close for comfort; Mother of victim stunned son's abuser can live so close after release

A recently-released sex offender is now living a few blocks away from the boy he victimized.

The victim's mother said she was stunned to learn 54-year-old Michel Maybury had moved so close to her Louisa Street residence. She's concerned about the safety of her own children as well as other youths in the east-end neighbourhood.

"My first thought was my poor son's not going to go anywhere," she said. "There are tonnes of kids that are outside playing at any given time. I'm worried about their safety (as well)."

City police issued a public safety notice Thursday to alert the community Maybury would be residing in Cornwall, however, they only learned of his proximity to the victim when the victim's mother contacted them on Friday. Maybury was released on Dec. 21 after serving a jail sentence for sexually assaulting a boy. He has other convictions dating back to 1974, including robbery, armed robbery, gross indecency, indecent assault on a male, indecent act, exposure to a person under the age of 14 and sexual assault.

When Maybury was sentenced, he was actually living in Martintown where the sexual assault occurred. It's believed he initially went somewhere else before moving to Cornwall at the end of January.

Aside from moving themselves, the victim and his family have little power to change the situation. Police said they don't have the legal power to force Maybury out of his current residence. However, they do have the power to closely monitor Maybury to ensure he's abiding by his conditions, and that's what they intend on doing.

Cornwall Police Chief Dan Parkinson said they will be paying "special attention" to Maybury, and if he takes one step "off that fine line," he'll be arrested and taken into custody.

Sgt. Jeff Carroll, a member of the Cornwall police sexual assault and child abuse unit, said they'll be taking a "variety of extra measures" to ensure Maybury abides by his court-imposed conditions.

"We will not be standing back and allowing him to just disappear," said Carroll.

Along with his probation, Maybury must also abide by a court-ordered lifetime prohibition that includes staying away from parks, swimming areas, school grounds and other places where children may be. He is also prohibited from using a computer to communicate with children under the age of 14 and working in any job that would put him in a position of power and trust over youths.

Still, the conditions and assurances from police are of little comfort to the victim's mother and she has temporarily sent her son away.

The mother said she has trouble understanding how a convicted sex offender with a lengthy criminal record can move so close to a victim without any trouble. She said she personally knows of a case where someone was banned by the courts from living in the city for a period of time for a series of break-ins.

"This is a man that stole my son's youth, he stole his innocence," said the mother.

The mother also doesn't understand how the offender could take up residence somewhere without getting some sort of approval first. According to her, the Crown said it would be seeking dangerous offender status for Maybury, but that never happened. Sgt. Carroll said both the dangerous offender application and a condition to live in a pre-approved residence would have had to be pursued at the time of sentencing, but they weren't. Officials from the Crown Attorney and probation and parole offices couldn't be reached for comment Tuesday. The mother said she's considering moving as a result of the situation. She can't understand why she wasn't notified about Maybury's release and subsequent move to Cornwall. She said she had to make calls on her own to determine when he was being released, and she only learned of Maybury's move to Cornwall after a family member saw it in the news last week.

"I have all these questions and no one's giving me answers," she said.

Carroll said he learned in early February that Maybury was moving to Cornwall, and he reported his new residence to police on Feb. 4.

The police sergeant said he didn't know where the victim was living and he only became aware of it after the victim's mother contacted him on Friday. For her part, the mother admits she's no stranger to the law and suggested police would have known where she resided.

As for the delay in issuing the public safety alert, Carroll said they had to research and gather the necessary info on Maybury first as the case wasn't a Cornwall police matter to begin with.

Both Carroll and Parkinson said it could be a coincidence that Maybury ended up living so close to the victim, and they suggested he might not have been aware of the fact when he took up his new address.

Parkinson said no one would have guessed Maybury would end up living that close to the victim. Still, given the size of Cornwall, it would probably be difficult for the victim no matter where Maybury chose to reside, he added.

"How far is far enough away that's going to give peace of mind and comfort to a victim and a victim's family?," he asked.

As for the prospect of the victim and his family moving, the police chief views that as unnecessary.

"The law's on her side with respect to his movements and his activities."

Interesting that with all the talk of Perry and the Inquiry, we have another man on his "apprenticeship" back out on the streets of Cornawall, came in Thursday and on Friday cops get a call from the victims Mother with concerns for her son and others kids in the community. And just a quick quote from Kev

Interesting statemnt which says it all when you tie it in with this quote:

Well as you can tell, the more thing change, the more they stay the same and the good citizens of Cornwall who have been placated (or tried to be) by the Chief about taking one step off the line and "Boy oh boy are we ever going to get you and put you back in jail if you aren't a good boy cause we're watchin you, gonna getcha sucker, don't move" and all that crap!

Then we have the "new Sheriff in Town stating that if he takes one step off that fine line "we're gonna watcha and getcha" if'n ya do, honest injun!

Meanwhile back at the "Ranch" this diddler had been let out Dec 21 and since then, the cops don't "really" know where he's been living! Ever consider checking it out with he "Proby", that'd be a nice start.

And Sheriff Dan Parkinson, answer this question for me will you, if your gang is paying such "special attention" to this diddler, that it took the mother of the abused to bring it to the attention of the cops to inform THEM that in spite of their warning on Thurday, and in spite of the "special attentions" you're paying to this diddler he's now just around the corner from his previous "VICTIM"!!! Yeh Sheriff, your gang is keeping a real close eye on this clown so close in fact that it took the mother of the victim to let you know where he was!! ONLY IN CORNWALL!!!!!! And the STUPID CITIZENS of Cornwall want to know why their town is so much in the news giving you a bad "Rep", well there's a PRIME EXAMPLE!!

In the last 34 years, the more things stay the same, they stay the same (or some quote like that!)

PEOPLE OF CORNWALL, YOU STILL DON'T GET IT, DO YOU??? By the by, is there some sort of IQ test your coppers have to take or what and if not, why not and if so, maybe the bar is set too low!!!! Or is it easier for all, that it's where it's at so we can "trip" over it.

WHY DONT WE GET cLAUDE mCiNTOISH TO LOOK AFTER THIS GUY HE LIKES TO PROTECT THIS BASTARDS. He would be persect for the job he could bring him to his coffee club and introduce him around maybe even buy him breakfast. Then he could introduce him to tne mayor and city council and we might even want to give him a key to the city. He might even get an invite to have dinner and the chiefs house. That would fit right in line with the way Cornwall treats these animals. But nobody had better put a hand on the creep or you will put behind bars. This city sucks and the justice here will never change.

The citizens of Cornwall should be ashamed the POLICE should be ashamed did the guy not have to report to the police where he is staying I thought that was required od sex offenders. O pardon me this is Cornwall home of the sexual offends where they are allowed to go free and continue to offend. Maybe we could get this guy to be a star attraction at the inquiry and be a special guest of Justice Glaude and the rest of the mpnkeys that perform there. SHAME on all the citizens of Corwall for sitting by and watching this take place and not voice your word. Where are all these church goers who think they are hollier that all the rest of us whay are not there voices heard loud and clear and all the CLERGY who prefess to be so goody good shoes

It says tons when a convicted pedophile chooses to move to Cornwall and just blocks from one of his ex victims. They are not afraid to come to Cornwall because these sickos are not afraid of being punished.

armagedon - you are absolutely right - Claude McIntosh should be assigned to interview this man and assist him with his healing. Claude is champing at the bit to do his part to help with community reintegration. Perhaps Claude can find out who raped this man when he was boy and sent him on the path of re-enactment and rage. Hopefully the police chief can assist with charge(s) being filed and perhaps the man can testify at the inquiry.

Our Police farce, Let me tell you couple of experiences with them.

One evening my car was broken into and a expensive stereo removed. When I reported it the officer just told me to call the insurance and gave me his id number so they could make the claim. Now had he visited they would have seen the blood all over the inside of the car and the trail leading down twelfth street to about the corner of Fatima. Whom ever did this really cut them self-bad. Now it is not a devastating crime but I bet the person went for stitches maybe with a little effort they could have found the person.

Another was property stolen from our car while at St Joe's. The door was jimmied at the lock. The rear seat torn away and my wife’s purse and school computers were stolen from the trunk of the car. The officer, you know the one, the dog cop now with the OPP, he explained that they hardly ever find vandals like this. He suggested we stop all our cards top prevent anyone from using. Stellar advise I tell you. The next day I went to the banks with a drive through ( thinkin like a villain harrrrr) and explained what happened and asked if the cards had been used. Low and behold one of the banks had the ATM card, as the person could not get the code right. The bank at the time did not have cameras at the machines but shortly after one camera from inside was turned to face the ATM.

If a citizen can do this, why can't the police? I mean what kind of crimes are you fighting?? Really what are you doing??? Are there that many underground issues that you cannot solve a common crime????

MY FATHER IS A MINISTER FOR THE UNITED CHURCH OF CANADA AND IT WAS HE AND MY MOTHER WHO ADAPTED ME THAT ENDED THE ABUSE OF ME so "whatjustice" I wouldn't advise you to go any farther than that about the CLERGY. You want to talk about ANY SPECIFIC CLERGY, you're welcome to that but when you say what you did, you insult my DAD and all other decent CLERGY and I don't tolerate that very well at all, so be cool as to who you call names to. Nobody is perfect, not me, not you nor anyone else except for that guy who died from "Hanging around on a Cross with holes in his palms and feet", know what I mean?
